Orgalime In-Brief edition 42.


On 13 February, we received details about the much awaited 'Product safety and Market Surveillance Package'.  At last the opportunity to level the playing field for legitimate market operators has been realised.  The package provides a solid footing on which to build a market surveillance system that not only protects the consumers from a health and safety aspect, but also (from our perspective), just as important, also the companies that invest much time, energy and money to ensure that their products are compliant to all European legislation, namely in the environment and energy fields. This is essential to keep manufacturing investment and jobs in Europe.

However
, at the last moment the controversial issue of marking of origin has been introduced into the CPSR proposal. Whatever position one might have on this issue, it is somewhat upsetting to see that, in spite of the better regulation drive, for the second time in less than a month (the other being the E-vehicle charging system in the draft Directive on alternative fuels infrastructure) the Commission has introduced new elements at the last moment into its proposals without impact assessment, prior consultation or warning. Hats off to the Commission on REACH - first signs that regulatory predictability and stability are filtering through

The European Commission adopted and published the outcome of the long awaited REACH review.  It is to say the least, satisfying to see that the European Commission is committed to moving towards regulatory predictability and stability - key factors in welcoming industrial investment back into Europe - perhaps just the catalyst needed to build on, allowing the manufacturing sector to continue adding value with a strong prospect of jobs and growth.  For once, a review has not resulted in a major overhaul of a piece of EU legislation as complex and critical as REACH - the focus rightly remains on implementation [more] 

Energy Efficiency Directive (EED): Main principles for implementation

The Commission is currently developing guidelines on the main provisions of the Directive, in cooperation with member states. We strongly support this Commission initiative which, we believe, should also reflect the good practices implemented over the past years in the member states.  

 

While there is no official consultation of stakeholders, we appreciate the opportunity given to stakeholders to contribute to these guidelines.

  • A workable and enforceable implementation
  • A clear EU wide approach ensuring the harmonisation of current and future practices of the different Member States, to the maximum extent possible, in delivering and reporting of progress against the targets and objectives of the Directive
  • Consistency and coherence with other EU legislation, especially the Ecodesign, the Energy Labelling and the Energy Performance of Buildings Directives
  • Avoiding excessive administrative and financial burdens for companies
  • Setting harmonised standards and a common calculation methodology for integrated energy performance of the buildings, while granting sufficient flexibility for companies to implement their own solutions
  • Acknowledging early movers and in particular avoiding penalising their efforts

Implementation Energy Efficiency Directive (EED): Comments on Draft Commission Guidelines        

Orgalime fully supports the objectives of the Energy Efficiency Directive that establishes a common European framework of measures for the promotion of energy efficiency to achieve the 2020 EU objectives and pave the way for further energy efficiency improvements. Concerning implementation, it should be ambitious, harmonised and timely to succeed in its goals.

 

The Commission is currently developing guidelines, in cooperation with member states, on the main provisions of the Directive with this in mind.  We strongly support this Commission initiative

Proposal for a Directive on the making available on the market of radio equipment (RED) 

While Orgalime welcomes the proposal for the revision of the Radio and Telecommunication Terminal Directive (R&TTED, 1999/5), we have some areas of concern, and especially with: 

  • Application of the "Lex Specialis" principle
  • Scope  
  • Scope exclusions  
  • Registration system
  • Declaration of conformity (DoC)
  • Translation of the DoC

European Consumer Day on product safety and market surveillance - 14 March 2013  

 

In 2013 the European Consumer Day is coming back to Brussels. The 15th edition of the event will be held in the EESC premises on 14 March 2013 and will focus on issues related to product safety and market surveillance.

European Conference 'SMEs and Standardization' - 28 May 2013 (save the date!)
