Unemployment Appeals - How Do You Rate?

The US Department of Labor periodically posts unemployment insurance (UI) Benefit Appeals data showing the UI Appeal Reversal rates when claimants appeal and when employers appeal. The average reversal rates are similar on a national basis.

For lower level appeals, employers prevailed 37.5% of the time during calendar year 2014. At the higher level, employers prevailed just 19.0% of the time.
 
Clearly, the chances of appealing and being successful are better at the lower level for employers. Despite similar national averages, there is wide variation state by state.

Tips for managing unemployment claims/appeals 

1. UI claim notices are often not routed to the right management person in a timely manner.  Hang "UI claims" posters in the mail room and train those who sort incoming mail.

2.  Documentation will set you free if the claim is not valid (i.e., for-cause).  Coaching/disciplinary/exit interview documentation will help prove your case.  Have copies available.  Many states conduct phone-hearings at the initial stage so faxing in forms in advance will need to be done.

3.  If witnesses are needed, ensure they are available for the date of the hearing(s).  If they are not, immediately ask for an continuance.

4.  If the UI claim is valid (i.e., layoff), consider severance to help reduce the UI experience. Plus, offer job placement assistance to help the former employees reconnect quickly. Printworkers.com is the largest printing industry job bank.

5.  Be aware of your state's unemployment insurance claims/appeals particulars.  Many states have manuals, newsletters, forms, etc. available for employers. (See links for Arizona, Colorado, New Mexico, and Wyoming).

Employee Theft Hits Small Firms Hardest - Part 1
    
Employee theft is a serious problem in the United States with small companies particularly vulnerable.

The main types of theft are outright theft of cash and check fraud, with rogue employees writing checks to acquaintances and trying to cover their tracks in the accounting system.

Half of employee thefts are perpetrated by individuals in senior posts, and the median age of perpetrators was 50, according to a report by insurance issuer Hiscox.

Hiscox based its findings on employee theft cases active in U.S. federal courts in 2014.  Among its findings:
  • More than 60 percent of employee theft involves women
  • Employees not in the finance or accounting departments commit more than half of all thefts
  • Nearly 75 percent of losses include direct theft of cash or misuse of bank deposits or transfers.

Profiling People Costs and Profitability

In the recent Flash Report, published by Printing Industries of America, Dr. Ron Davis reviewed several key factors which clearly point to the fact that the industry's more profitable firms have less labor costs (as a percentage to total sales) than their less profitable peers. 

The total difference (as a percentage of sales) was 5.2%, which represents nearly half of the profitability difference between the industry's profit leaders (top 25%) vs. the rest of the industry (profit challengers).  The one area that Dr. Davis did not delve into deeply - but has a significant affect, is that the profit leaders have less people - but generate more sales.  It's an effective use of technology as well as personnel. Maximizing our company's resources - labor and equipment - nearly always leads to profitability.

What Is Your Life Worth?

Like most business owners, you are concerned primarily with running your day-to-day operations and growing your business-oftentimes, planning for your retirement may be secondary.

According to a 2009 study of small business owners, less than half (47 percent) of the business owners surveyed had a way to save for retirement that was set up through their business. Twenty-eight percent were not saving at all!
For those looking for a simple, yet effective, source of supplemental retirement income, an excellent option may be a permanent life insurance policy.

The cash value in the policy accumulates on a tax-deferred basis during your working years, and can be withdrawn tax-free during your retirement years (in the form of policy loans and withdrawals). Unlike qualified retirement plans, such as a 401(k) or IRA, the contributions are not pre-tax. However, the policy does offer you significant flexibility.
  • In addition to the ability to avoid income tax on policy loans or withdrawals, there are no limits on when money can be taken. Money may be loaned from the policy, or you may take withdrawals from the cash value as soon as such values exist.
Unlike most retirement plans, which impose early withdrawal penalties until age 59½, values in permanent life insurance are accessible to you without waiting. Further, with a life insurance policy, withdrawals or loans are not required after age 70½ if they are not needed.
  • The income tax-free death benefit can provide a ready source of funds for surviving family members to meet their income needs in the event of the business owner's death.
  • Although premiums are paid with after-tax dollars, these dollars may be deductible to the company as compensation for C corporation owner-employees (and non-owner key employees).
Keep in mind each individual's financial needs are unique. Borrowing from a life insurance policy or surrendering coverage to access a policy's cash value may not make sense for everyone. On the other hand, a permanent life insurance policy can protect your family and offer you options.
