GEOGBA Updates Index of Limitation-of-Liability Decisions

The Geoprofessional Business Association (GBA) has published a new edition of Limitation-of-Liability Case Index, an important legal reference conveying in lay terms the results of 75 cases where the legality of limitation-of-liability provisions has been challenged in the courts, usually without success. Available free of charge, the GBA document is particularly useful for geotechnical and other civil engineers, architects, other design professionals, environmental scientists, construction-materials engineering and testing (CoMET) professionals, and others who include a limitation-of-liability provision in their contracts or are thinking of doing so, as well as their legal counsel. The Index was prepared for GBA's Legal Affairs Committee by Committee Vice Chair Terence J. "Terry" Scanlan, Esq., a principal of the Seattle (WA) law firm Skellenger Bender, P.S.

 

Although the limitation-of-liability (LOL) concept is 400-years-old, it was GBA that innovated its application to the design, environmental, and CoMET professions in 1969. By applying the concept, now upheld in most states, a client agrees to limit a design professional's liability to a given amount, most commonly $50,000 or the fee, whichever is higher. Without using "legalese," the Index describes each of the 75 listed cases in terms of its background and the points or holdings involved, and - to support additional research - identifies the case by name, jurisdiction, and citation. The cases span the period 1956 to 2014.

ABOUT THE INSTRUCTOR

Dr. Mehdi Setareh, P.E. is Professor of Architecture in the College of Architecture and Urban Studies at Virginia Tech. Dr. Setareh is a licensed professional engineer in the states of Virginia and Michigan and is a member of the American Society of Civil Engineers, American Concrete Institute, American Institute of Steel Construction, and the Architectural Engineering Institute. He is the author of the "Concrete Structures" published by the Prentice-Hall Book Company.

BIABIA Opens Entries for 2015 Annual Brick in Architecture Awards
 

The Brick Industry Association (BIA) invites entries for its 2015 Brick in Architecture Awards starting on February 16, and due by April 30. BIA's annual design competition honors outstanding, innovative and sustainable architecture that incorporates clay brick products as the predominant exterior building or paving material. Competition rules and entries will be conducted online and winners will be announced in June.

 

"The Brick in Architecture Awards program offers the most prestigious juried competition of its kind," said Ray Leonhard, BIA president & CEO. "Architects are inspired by fired clay brick's aesthetic flexibility to match their imagination and desires, and as a material made from abundant natural resources, it's a perfect strategy in sustainable design."

 

Architectural and design firms may enter their best projects to be judged by a jury of their peers. Any work of architecture completed since January 1, 2010, in which new clay brick products comprise the predominant exterior building or paving material (over 50 percent), is eligible. These include face or hollow brick, building brick, thin brick, paving brick, glazed brick, structural glazed facing tile, new clay brick products in special shapes and/or a combination of any of these aforementioned units. An entrant may submit more than one project for consideration, and previously submitted projects can be entered once again as long as they were completed since 2010.

wohlsenWohlsen Construction Apprentice Wins Top Carpentry Award at National Craft Championship
 
Mark Rineer at National Craft Championship

Mark Rineer of Wohlsen Construction received the Gold Medal for Carpentry at the National Associated Builders and Contractors (ABC) Craft Championship in Fort Lauderdale, Florida.

 

After winning the Gold Medal for Carpentry at the local level at the Keystone Chapter of ABC's Craft Competition, Rineer qualified for the national competition. 187 craft trainees competed in the two-part National Craft Championship. The first part consisted of an extensive written exam, and in the second part contestants participated in a daylong, hands-on performance test.

 

Rineer's Gold Medal in Carpentry is the fourth time that a Wohlsen apprentice won the Nation's Top Award in the last five years.

 

National Associated Builders and Contractors is comprised of 70 chapters representing more than 21,000 merit shop construction and construction-related firms.

 

Wohlsen Construction Company, celebrating its 125th anniversary, is a Green Plus Certified company, and one of the leading merit shop construction firms in the Mid-Atlantic States.
