So if April showers bring May flowers... what do May flowers bring? Finish reading my article and you will see the answer at the end. As we move headlong to the end of the month of May I remembered that back in 1958 May 1st was established as Law Day, a national day that was set aside to celebrate the rule of law. Law Day underscores how law and the legal process have contributed to the freedoms that all Americans share. Your leadership team has recently completed two trips in the last three weeks to help in the fight for legislative issues that affect REALTOR'SŪ business and our client's homeownership rights.

In California we traveled to Sacramento for Legislative Day. Over two thousand REALTORSŪ attended and marched to the Capitol to meet with our legislators to help push our agenda. The three main items we are pushing for are 1.) PACE Loan Disclosure (AB 2693)-Sponsor: we know they are not going away. Our objective is to push to have these loans moved out of "super lien" status so lenders are more able to establish new mortgages on property purchases as well as free up the ability to refi existing loans. Also we want better disclosures made available to the homeowner considering this type of loan. 2.) Companion Animal Regulation (AB 2760)-Sponsor: to statutorily distinguish between a medically necessary companion or support animal and other animals kept as pets. This legislation would help landlords to avoid unnecessary litigation. 3.) Section 8 Housing Mandates (SB 1053)-Oppose: it forces residential rental property owners to involuntarily participate in the federal and local government's voluntary Section 8 housing program.

In Washington DC thousands of REALTORSŪ from all over the country assembled and met with legislators over the course of 3 days to help push our agenda. We had already received much needed support from the House of Representatives on two bills: HR 3700 which makes much needed reforms to the FHA condo loan program, federal assisted housing programs and Rural Housing Service loan programs which could open the market on more condos being available to sell with FHA backed mortgages. HR 2901 Flood Insurance Market Parity and Modernization Act which would create an "open market" scenario for homeowners to obtain flood insurance from private insurance companies vs the NFIP. Both bills passed unanimously with bipartisan support and we were pushing our Senators to get it to the Senate floor for voting. The 4 additional issues we pressed for were 1.) No more G-Fees being extended, increased, and diverted for unrelated government spending, if you recall last year they were trying to raise the fees on homebuyers obtaining mortgages to help pay for freeways. 2.) Reject tax reform plans that eliminate or marginalize the mortgage interest deduction for primary and secondary homes. Each year we fight this battle and we know this is one of our homeowner's most likely largest tax deductions they enjoy each year. 3.) Say NO to tax reform that repeals the property tax deduction. 4.) Do not repeal the Section 1031 Exchange provision, it would harm economic growth

As you can see our business is heavily attacked in the political arena. Fighting bad politics does cost money...I encourage all of you to get involved and to voluntarily contribute at either the state or national level or better yet BOTH, help starts as low as $20! The MLS department has received a few calls lately about offers not being presented. We would like to remind everyone of the rule regarding this. 
Presentation of Offers, states: The listing broker must make arrangements to present the offer as soon as possible, or give the cooperating broker a satisfactory reason for not doing so. In the event a listing broker will not be participating in the presentation of offers, the listing broker shall clearly indicate this fact in the listing information published by the service.

Directions in MLS
Another incident we've been seeing is a lack of directions to the property on listings. The directions field is a required field. As such, it may not contain things like "use GPS" or "Google Maps." Please provide accurate directions to the property. Failure to do so is considered inaccurate information and is subject to a penalty.
