C.A.R. Legal Updates
The standard forms published by C.A.R. for use in real estate transactions are protected by copyright law.  To ensure that the value of the copyright is preserved, C.A.R. vigorously pursues and prosecutes persons who commit copyright infringement on the standard forms.  Occasionally, a person inadvertently commits copyright infringement because he or she lacks an understanding of basic copyright law.  Therefore, to clarify the application of copyright law to C.A.R.'s standard forms (including forms available on zipForm®) and to avoid unnecessary prosecutions, the following Q & A addresses the main questions that arise with respect to copyright law and C.A.R.'s standard forms.
 
Beginning October 3, 2015, the Good Faith Estimate (GFE), the HUD-1 and the Truth-in- Lending Act (TILA) disclosures will be replaced in most transactions by two new forms - the Loan Estimate and the Closing Disclosure. 

The Loan Estimate will be required for most transactions in which a loan application was received on or after the effective date. It replaces the GFE and the initial TILA disclosures. The Closing Disclosure will be required for any transaction in which a Loan Estimate was issued. It replaces the HUD-1 and final TILA disclosures.

Mark Oct. 8 in your calendar. That's the best date to close on a home at a bargain price, according to a new study by RealtyTrac.

On average, buyers have purchased 10.8 percent below estimated market value on this date for the last 15 years, the study shows. The next best buying dates for house hunters are Nov. 26 (10.1 percent below market value); Dec. 31 (9.7 percent); Oct. 22 (9.6 percent); and Oct. 15 (9.1 percent). RealtyTrac analyzed more than 32 million sales of single-family homes and condos to come up with the data.

Overall, October offered the most promise for bargain hunters. Over the last 15 years, the 2.7 million sales that have closed in October carried an average sales price 2.6 percent below the average estimated full market value at the time of sale. After October, the best deals are in February, July, December, and January.

As in past years, the audience will vote by texting their choice at the conclusion of all the performances.  The winner of REALTORS® Got Talent will receive $2,000 and the other finalists will receive $500.....along with the accolades of the 5,000 REALTORS® in the audience that night.    One of the finalists for this year's REALTORS® Got Talent contest at the REALTORS® Conference & Expo in San Diego is from YOUR state or local association!
