NEW VISA BULLETIN FORMAT: USCIS AND DOS ANNOUNCES REVISED PROCEDURES FOR DETERMINING VISA AVAILABILITY FOR APPLICANTS WAITING TO FILE FOR ADJUSTMENT OF STATUS.
USCIS, in coordination with Department of State (DOS), is revising the procedure for determining visa availability for applicants waiting to file for employment-based or family-sponsored preference adjustment of status. The revised process will better align with procedures DOS uses for foreign nationals who seek to become U.S. permanent residents by applying for immigrant visas at U.S. consulates and embassies abroad.

This revised process will enhance DOS' ability to more accurately predict overall immigrant visa demand and determine the cut-off dates for visa issuance published in the Visa Bulletin. This will help ensure that the maximum number of immigrant visas are issued annually as intended by Congress, and minimize month-to-month fluctuations in Visa Bulletin final action dates.

For more information, or if you believe that you or a friend or colleague may be able to benefit from this recent announcement, please feel free to contact the Immigration and Nationality Lawyers at the Nachman Phulwani Zimovcak (NPZ) Law Group, P.C. at 201-670-0006 (x107) or by e-mailing us at info@visaserve.com
WHEN TO FILE YOUR ADJUSTMENT OF STATUS APPLICATION TO FILE FOR CONSULAR PROCESSING FOR FAMILY-BASED OR EMPLOYMENT-BASED PREFERENCE VISAS.
Are you seeking to adjust your status and become a U.S. permanent resident under a family-sponsored or employment-based preference immigrant visa?  If you have not yet had a relative or employer file an immigrant visa petition on your behalf, you can learn more about the Adjustment of Status Filing Process. If you already have a petition filed or approved on your behalf, you may have to wait for an available visa in your category (if applicable) before you can file your Form I-485, Application to Register Permanent Residence or Adjust Status. The linked page(s) will help you determine when to file your adjustment of status application.

NEW DEVELOPMENTS IN U.S. IMMIGRATION LAW: FIVE THINGS YOU SHOULD KNOW ABOUT OCTOBER, 2015, VISA BULLETIN:
1. There are two important dates listed on the monthly Visa Bulletin: the "filing date," which determines when individuals can submit their permanent residence applications, and the "final action" date, which determines when the Department of State or USCIS can make a decision on the applications.

2. If the immigrant has a "priority date" earlier than the listed "filing date" for their particular visa category and country, they will be able to file their applications for permanent residence earlier than they would have been allowed under the old process. However, they will still have to wait for the "final action" date to become current before permanent residence can be approved.

For more information, or if you believe that you or a friend or colleague may be able to benefit from this recent announcement, please feel free to contact the Immigration and Nationality Lawyers at the Nachman Phulwani Zimovcak (NPZ) Law Group, P.C. at 201-670-0006 (x107) or by e-mailing us at info@visaserve.com.
THE OCTOBER VISA BULLETIN: FILE FOR AOS BEFORE YOUR PRIORITY DATE IS CURRENT?
A new monthly visa bulletin summarizes the availability of immigrant numbers during October for: "Application Final Action Dates" (consistent with prior Visa Bulletins) and "Dates for Filing Applications," indicating when immigrant visa applicants should be notified to assemble and submit required documentation to the National Visa Center.

Unless otherwise indicated in this bulletin, individuals seeking to file applications for adjustment of status with U.S. Citizenship and Immigration Services (USCIS) in the Department of Homeland Security must use the "Application Final Action Dates" charts below for determining when they can file such applications. This bulletin may indicate the ability for such individuals to instead use the "Dates for Filing Visa Applications" charts, when USCIS determines that there are more immigrant visas available for the fiscal year than there are known applicants for such visas.
