Dear Readers:

Before we move to our monthly announcements about immigration law politics and recent U.S. immigration law issues, the Nachman Phulwani Zimovcak (NPZ) Law Group, P.C. wants to thank each and every one of its loyal readers for their ongoing support and for the positive advancement of pro-immigration reform issues over the past several months. We also want to take this opportunity to wish our clients, and our readers, a very safe, happy and healthy holiday season and continuous prosperity in the coming new year. Of course, we all continue to hope that 2014 will be the year of Comprehensive Immigration Reform in the U.S.!!

Before Congress left Washington D.C. for its recent holiday recess, the House of Representatives approved a two-year budget deal. Some say that the celerity of the compromise was because of the fallout from the last budget dispute. The budget will now go to the Senate for a vote. Interestingly, the Speaker of the House of Representatives, John Boehner (R-Ohio), attacked extremely conservative factions within the Republican Party. He stated: "I think they're pushing our members in places where they don't want to be. And frankly, I just think that they've lost all credibility."

There are several recent positive signs that immigration reform may move forward in 2014. First, Boehner is resisting the ultra-conservative stance of the tea party. Many see this position as a positive sign that Boehner would resist tea party critics and allow a vote on a budget that will avert a government shutdown in January. Second, Boehner hired a new staff member to focus on immigration legislation. This leads some to believe that House leaders will take up bills in 2014 to fix the nation's immigration system. Third, House Judiciary Committee Chairman Bob Goodlatte said at a Hearing recently that immigration reform would be a "top priority" in 2014 for the House of Representatives.

The pressures for immigration reform have been internal as well as external. In addition to the foregoing, immigration activists continue their push for improved immigration policies. U.S. Immigration reform supporters continue to flood congressional offices with calls and letters and visits. The focus of recent immigration reform efforts is to draw attention to House leaders' inaction on immigration reform bills this year. This, of course, is coupled with the fact that it is being reported that a majority of Americans favor reform that includes a pathway to citizenship for undocumented immigrants.

IS THERE ANY MOVEMENT IN THE HOUSE REGARDING COMPREHENSIVE IMMIGRATION REFORM?    

If it wasn't already clear where the House Republican leadership stood on immigration, it is now. As noted from various press sources, recently, Speaker John Boehner announced the hiring of Rebecca Tallent to be his Immigration Policy Advisor. Tallent was most recently the Director of Immigration Policy for the Bipartisan Policy Center, a business-oriented group promoting amnesty and massive increases in permanent and temporary immigration. Prior to that she worked for Senator John McCain and helped draft the McCain-Kennedy amnesty bills of 2006 and 2007.

It is that time of year again! We always hear the accountants moan and groan about the approaching April 15th tax deadline each year but, you have to listen a bit more closely and you will hear (and see) the U.S. business immigration lawyers and attorneys manifesting their distaste for the April 1st filing date for "cap" subject H-1B professional and specialty occupation workers.

USCIS' NEW PROVISIONAL UNLAWFUL PRESENCE WAIVER PROCESS STILL HAS PLENTY OF ROOM FOR IMPROVEMENT.

In March of this year, United States Citizenship and Immigration Services (USCIS) implemented a new waiver process for certain immediate relatives of U.S. citizens who are ineligible for U.S. legal permanent residence due to their unlawful presence in the United States.  

 

This waiver, called the provisional unlawful presence waiver, allows these individuals to apply to waive their inadmissibility for unlawful presence prior to departing the United States. Although this was a welcome development, the implementation of the new process has, unfortunately, met with some serious adjudication obstacles. Many waiver applicants and their representatives have received unwarranted denials or overly broad evidentiary requests including requests for information that was previously submitted.

U NONIMMIGRANT VISAS FOR VICTIMS OF CERTAIN CRIMES: A POPULAR VISA CATEGORY FOR THE 5TH STRAIGHT FISCAL YEAR.

For the 5th straight Fiscal Year, USCIS has approved the

statutory maximum 10,000 petitions for U-1 nonimmigrant status (U visas) for fiscal year 2014. Each year, 10,000 U visas are available for victims of certain qualifying crimes who have suffered substantial mental or physical abuse and are willing to help law enforcement authorities investigate or prosecute those crimes.  

 

 A U visa petition requires certification of assistance from law enforcement. More than 89,600 victims and their family members have received U visas since the program was implemented in 2008. Though USCIS has reached its statutory cap of 10,000 U visas, it will continue to review pending petitions for eligibility.

A newsletter was recently promulgated by the USCIS' Vermont Service Center. The newsletter is a continuing effort by the USCIS to outreach to the public.

NEW VISA BULLETIN PROMULGATED BY THE DOS: JANUARY 2014 VISA BULLETIN IS OUT!!!!

The State Department released the Visa Bulletin for January 2014. There was forward movement in the employment-based third preference and other worker categories, as well as in some of the family-based preference categories.  

 

Be sure to check your priority date to see if it is current.

TERMINATION OF EMPLOYMENT FROM EMPLOYER SPONSORED IMMIGRATION  PETITIONS:   
H-1B visas are nonimmigrant visas that allow foreign workers in specialized occupations to reside and work in the United States for a limited time period. To qualify, a foreign worker must be sponsored by a U.S. employer. Employers can terminate an H-1B visa worker without penalty; however, doing so causes the employee to immediately lose status to live and work in the United States. Because of the immediate circumstances for the employee, this triggers obligations for the employer. When terminating, the employer must begin by providing clear, unequivocal notification of a "bona-fide termination" to the employee. It must be done in writing and clearly indicate that the employment relationship has been terminated.   
COMPREHENSIVE IMMIGRATION REFORM (CIR): PAROLE IN PLACE & MILITARY FAMILIES.
 
'Parole in place': Obama's illegal-immigration order stokes amnesty worries - More on the recent directive from the Obama administration that allows immigration officers to "parole in place" the parents, spouses, and minor children of U.S. military members. The policy allows relatives who are in the U.S. illegally to apply for legal status without having to leave the country. It's drawing criticism from those who want more restrictive policies. It is a form of Prosecutorial Discretion. The President can act on immigration without Congress. 
THE U.S. DEPARTMENT OF STATE PROMULGATES THE VISA BULLETIN FOR JANUARY 2013 - BUT LET'S TALK ABOUT DECEMBER'S NUMBERS!

Consular officers are required to report to the Department of State documentarily qualified applicants for numerically limited visas; U.S. Citizenship and Immigration Services in the Department of Homeland Security reports applicants for adjustment of status.  Allocations were made, to the extent possible, in chronological order of reported priority dates.
