Dear Readers:

The message is not new . . . immigrant entrepreneurs create jobs, bring in additional revenue, and contribute significantly to the economy. Highly skilled immigrants are vital to the States' innovation activities, spurring further growth. As such, local leaders and advocates recognize the importance of immigrants in their communities and support immigration through local "welcoming" and integration initiatives. Clearly, immigrant entrepreneurs make important contributions throughout the U.S.

Also in the Immigration News, the House of Representatives held Hearings that highlighted similarities between Senate Immigration Bill and House Border Bill. The July 23rd hearing of the House Homeland Security Subcommittee on Border and Maritime Security was about the many differences between the Senate's immigration-reform bill and the House's border-enforcement bill. The hearing was even titled "A Study in Contrasts: House and Senate Approaches to Border Security." While highlighting very real differences between the House and Senate approaches to immigration reform, the hearing inadvertently shed light on the many similarities between the two when it comes to border security. The Congressional recess is looming and it is unlikely that additional work will be done by the House.

In other U.S. Immigration Headlines, it appears to be clear that Immigration Reform is an Imperative for Cities and Metropolitan Areas. Metropolitan leaders from around the country made the case for immigration reform at a recent event hosted by the Brookings Institution's Metropolitan Policy Program. Over 80 percent of the U.S. population, including 95 percent of immigrants, now live in metropolitan areas; cities and towns across the country therefore have a huge stake in passing immigration reform. In fact, panelists agreed that comprehensive immigration reform is an imperative for metropolitan areas. "We need an immigration system that is keeping with the times," stated Audrey Singer, a Senior Fellow with Brookings.

IMMIGRATION REFORM BILL 2013! - THE TOUGH QUESTION IS WHAT'S GOING ON??
Now that the Senate has passed a bipartisan bill, we need to wait and see what happens in the House of Representatives. Will the House take up the Senate Bill and pass something like it or will the House of Representatives produce its own bill that includes a core piece of the Senate Legislation. We are all hoping that the House of Representatives will include a pathway to Citizenship for the 11 million unauthorized immigrants in the country.
 
DOMA UPDATE: SAME SEX MARRIAGE CASES - IMMIGRATION BENEFITS 2013.
Recently, the Supreme Court struck down a key part of the Federal Defense of Marriage Act (DOMA) and declared that same-sex couples, who are legally married, deserve equal rights to the benefits under federal law that go to all other married couples. The decision is a landmark win for the gay rights movement. It voids a section of the law known as DOMA, which was adopted with bipartisan support in Congress in 1996 to deny all benefits and recognition to same-sex couples.

You have likely heard a great deal about it. Please be sure to check your priority dates immediately. The following information is provided by the Visa Office regarding the cut-off dates for the month of August 2013.

 

FAMILY PREFERENCES:

F1 - Family first preference: Unmarried sons and daughters over the age of 21 years of U.S. Citizens. The cut-off date has moved forward by twelve (12) weeks for most of the countries including India to September 1, 2006.

The long awaited Comprehensive Immigration Bill (CIR) is now at the door steps of the House. As per the Washington post-ABC News poll, majority of Americans support the CIR bill that accompanied the strong fencing along the U.S - Mexico border and boosting the economic through increasing the manpower. It is reported that around 55% of the Americans support a pathway to citizenship for 11 million undocumented immigrants. Now its time for the House of Representatives to decide on the fate of the bill and the 11 million undocumented individuals waiting for years to reunite with their families.
 
ONE BAD APPLE CAN SPOIL A WHOLE BUSHEL: AN INSIDE STORY ABOUT AN H-1B FRAUD CASE.
H-1B visas brings highly skilled workers to the U.S for the economic benefits of the country. However, the H-1B is not supposed to be sacrificing workers rights and privileges. On July 1st an H-1B fraud case judgment was made by a federal jury, the U.S Attorney's Office for the District of Colorado. According to the indictment and evidence presented at trial, suspects were involved in a scheme of making false representations to foreign nationals, to the State of Colorado, to the United States of America, and to others, for the purpose of obtaining illegitimate payments. The case reveals the real meaning and importance of the proper use of the H-1B program by employers.

Beginning March 4, 2013, certain immigrant visa applicants who are spouses, children and parents of U.S. citizens (immediate relatives) can apply for provisional unlawful presence waivers before they leave the United States. The provisional unlawful presence waiver process allows individuals, who only need a waiver of inadmissibility for unlawful presence, to apply for a waiver in the United States and before they depart for their immigrant visa interviews at a U.S. embassy or consulate abroad.

MORE ICE AUDITS ON THE WAY! If the wrong version of the Form I-9 was completed when the employee was hired, an employer should try to rectify the error.  The best way would be for the employer and employee to complete the current version of Form I-9 and staple the previously completed Form I-9 to the current version.  Include an explanation of what happened and sign and date the explanation. If the employer is unable to have the employee and employer complete the current version of Form I-9, the employer could try to rectify the error.

Promoting public understanding of the best ways to find bona fide legal advice and avoid scams
Building capacity for legitimate assistance and services
Supporting enforcement action against those who engage in the unauthorized practice of immigration law
