Drilling Down into Title Opinions
by Rick Lindhome

Have you noticed the ever-expanding length of title opinions? Many of the opinions that cross my desk today are replete with esoteric property issues that are collateral to the two essential questions a title opinion seeks to answer:

  1. Can we put a hole in the ground?
  2. If not, what are the essential steps we need to take to fix that?

It is easy for title attorneys to get lost in the minutiae and lose sight of these primary objectives. I don't make light of the complexity of title work: Pennsylvania, for instance, has the longest-standing oil and gas law in the country, and much of that law is not intuitive. But the fundamental job of the attorney is to advise our clients, not to dwell on creating an opinion so convoluted that it eviscerates the usefulness of the certification it provides.

Truly useful legal advice takes experience and industry knowledge by the attorney. At Lindhome & Songster, our attorneys understand the business pressures of today's oil and gas industry and provide concise, responsive,cost-effective counsel to our clients.
