Dealey Renton & Associates (DRA) is one of the largest specialty brokers in the country, representing more than 3,000 design professional firms.  Our focus for more than 50 years has been to assist our valued clients with their risk management, loss prevention and insurance placement needs. We believe this month's articles will help our clients manage their business risks and improve their professional practices.

Copyrights
A brief article by Jacqueline Pons-Bunny, Esq of Weil & Drage outlines the implications for design professionals of giving clients ownership of documents and provides practical steps firms can take to minimize the effect when compelled to give up ownership and legal rights.

Contracts
Design Professionals receive a very modest financial reward from a project when compared to the Owner or Contractor. DRA revisits the history of the limitation of liability clause and the importance of including this risk allocation tool in contract negotiations, especially where the fee is relatively small and the risk is high.

Risk Management
Steve Rowinski, Risk Manager for Arrowhead Design Insurance comments that unrealistic clients with unrealized expectations tend to respond to project problems with confrontation rather than cooperation.  He provides ideas to create workable expectations in an effort to avoid professional liability claims.
