Majority of House of Representatives Now Opposes RIAA-Backed Performance Royalties on Local Radio

A majority of the House of Representatives now supports the Local Radio Freedom Act, a resolution that opposes "any new performance fee, tax, royalty, or other charge" on local broadcast radio stations. The resolution, which was introduced in Congress less than eight months ago, has 220 co-sponsors in the House of Representatives and 24 in the Senate.

"Local radio stations and the record industry have enjoyed a mutually beneficial relationship for decades that has spurred enormous music creation by new and established artists," said NAB President and CEO Gordon Smith. "We applaud lawmakers for opposing a job-killing performance royalty that would damage this partnership and hurt local radio's ability to serve our communities. Broadcasters across the country look forward to continuing to provide billions of dollars in promotional value for free radio airplay."

Five of Kentucky's six Representatives have signed on as co-sponsors.
FCC gives AM radio "the best of both worlds."
Source: Tom Taylor Now

Ben Downs of Texas-based Bryan Broadcasting once led an NAB Radio Board task force on AM revitalization, and he tells this NOW Newsletter that Friday's FCC Report & Order "gives us the best of both worlds - a 250-mile super-waiver, and a translator window for broadcasters priced out of the translator market."

Many operators feared the worst out of the "AM Revitalization" item that's been dribbled around the 8th Floor at the FCC for months. We kept hearing that Chairman Tom Wheeler wouldn't permit a dedicated window for AM stations to file for a companion translator. But Friday, he did, though it won't occur until 2017.

The more immediate prospect for translator captures by AM operators is the "window-lite" proposal for a waiver process that Audio Bureau Chief Peter Doyle was talking up at last month's Radio Show in Atlanta. It would let AM owners import a translator companion from as far away as 250 miles, under the right conditions. So Wheeler stretched for a whole Christmas package, as did the other four Commissioners.
