NEW YEAR
SAME STORY!


The 114th Congress was sworn in on Tuesday January 6, 2015 and from the looks of things it appears not much will change. This year we can anticipate a continuing move toward Corporatism at the expense of the citizenry.  The infatuation with Big Business coupled with the disdain for governance and the commonwealth will serve to further the expanding erosion of individual wellbeing rights and freedoms.  

True to form the first peace of legislation introduced in the new Congress was a bill to further restrict reproductive rights. Now our Nation faces many challenges, blood is literally running in the streets, segments of our society harbor deep and well founded mistrust of one another, talk of nullification emanates from State Capitols and our Courts have been politicized, one must therefore wonder in this environment what would motivate a legislative body to this end a desire to unite or divide?

Coupled with the back door procedural attack that has been perpetrated upon Social Security, which in effect pits those who receive Social Security Retirement benefits against those who receive Social Security Disability benefits designed to create a war amongst the elderly and disabled over an ever shrinking benefit; it is clear that we are being led once again on the path of division not unification.



In Florida  the Legislative session starts in March but yesterday the legislators where in Tallahassee measuring the drapes.  One has to wonder why bother it's the same old ideology.

At his inauguration our Governor promised to both cut taxes by a billion dollars and increase spending on education by a billion dollars. This is what I call a Scottism, which is when you say something that is so obviously and blatantly untrue that there is no foundation in reality to measure it against. Assertions made in a vacuum where reality does not exist. 

Rick Scott could get up in the morning and declare that the sun rose in the west and set in the east without blinking an eye. There was a time when prevarication was considered a sin and if you were caught lying it would cost you your political career. It now appears that the lie has been elevated to an art form and that governing is nothing more than political theatre.


So here we go another year another opportunity for our legislators to prove themselves worthy of the challenge of governing this great Nation and State.  I pray that they are inspired by their positions, and that they rise to meet the grandeur of the offices that they hold as opposed to by their deeds further diminish our trust in government.  It's going to be an interesting year.

BUYER BEWARE!
Mortgage Companies  Attempt 
to take the Law out 
of Foreclosure!




Mortgage Companies doing business in States that require judicial proceedings to foreclose on a property (Judicial Foreclosure States) such as Florida, have come up with a new device designed to deny homeowners their day in Court and further stack the deck in their favor.


 

Not content with the current status of the law which heavily favors lenders in foreclosure proceedings, Mortgage Companies have come up with a new device to eliminate Judicial review of their activities altogether. 


 

The device is called a deed of trust.  A deed of trust involves three parties: a lender a borrower, and a trustee.  The lender gives the borrower money.  The borrower gives the lender a promissory note and as security for the promissory note the borrower transfers the property to a Trustee.  The borrower is nothing more than a tenant during the term of the promissory note. A new Mortgage Trap!

 

 

The Mortgage Companies have been quietly switching from standard mortgages to "deeds of trust".   Generally deeds of trust can be foreclosed without judicial intervention or oversight and depending on the State in the absence of any Court proceedings at all. Deeds of Trust

 

 

The Attorney General's of several States have become aware of this widespread practice.  It will be interesting to see if these practices are challenged, by state officials particularly here in Florida.


 

If you are in the market or currently buying a home make sure that the documents that you are singing are in fact a mortgage and not a deed in trust.  We recommend having an attorney review your documents prior to closing so that you are protected.

        "Somebody's watching you"



The right to privacy does not exist.  Most people mistakenly conflate the Constitutions limitations on Governmental activities with a limitation on the activities of all members of our society.  this is not so, private individuals and organizations face little constraint under our laws from collecting selling and packaging the most intimate information about you.

Over the last five years a new industry dedicated to scoring has developed.  Most people are familiar with credit reporting bureaus and their FICO, scores.  The credit rating industry is but the tip of the iceberg.  Further, unlike the credit reporting agencies these new scoring entities are not regulated and not required to allow you access to your score or disclose their scoring methodology.  

These companies collect data from your computers, smart phones, electronic banking transactions, cable subscription companies and other electronic data sources, including location data, spending habits, loitering (web sites that you visit often or spend a longer than average time viewing). This information is used to compile a scoring matrix that is then used to make discussions about you and your habits.

With these new scoring companies there is no requirement that you be allowed to see your score or what actions or behaviors constituted your score.

Not only that but your score is available for a price to all types of entities.  The scoring companies are even able to tailor their parameters to satisfy specific industries.  

I encourage my clients to contact the elected representatives and demand that this new industry be regulated.  Minimally, the same guidelines that apply to the credit reporting agencies should apply to these scoring companies.

We are all about literacy here at the Law Offices of James Sweeting III LLC.,  To that end we are announcing our Saturday Morning Book Club, beginning this Saturday January 10th, 2015 and meeting bi-weekly every second and fourth Saturday of the month we will be hosting a book club to discuss and review books that highlight the legal system and historical trends in our society that have brought us to the present day.   Meetings are held at our Offices at 618 E.
