This time of year always holds so much promise as well as fear. As we enter 2015 we at the Law Office of James Sweeting III, LLC., pray that in the year to come your heat and mind are focused on the promise and not directed at the fear.
2014 may have been a year of trial and challenge for you, if so we encourage you to put those matters behind. Remember, no race is won by looking backward.
There is much to do in the year ahead. Our Nation and Community are faced both with opportunity and challenge. We are committed to assisting you in facing those challenges and educating you as to the legal issues that impact upon our society.
We are working to meet this commitment through our Legal Practice, our "Take it to the Streets" program, our work with the Randolph House and through our media services including this Newsletter and other writings.
It is our goal through these productions to provoke thought and action without being disagreeable or disrespectful and most of all to educate and provide a service to our clients. We look forward to your joining us throughout 2015, but for now most of all we wish you a very happy New Year.

POLICE STATE?
American coup!

The end of 2014 brings us to a time of peril, when we are again facing fundamental challenges to our republic and democratic system of government. Indeed we are faced with the question of what happens when law enforcement, the military and other institutions of our government are demonstrating a lack of respect and refusal to submit to the authority of their direct civilian supervisors and thus are rejecting civilian control. We have a history where our government particularly the police and military branches of our government have not only deferred to civilian authority but have embraced it. However recently in two very illustrative and telling events these powers have demonstrated an unwillingness even a hostility to civil authority or control.
What happens when in a society the aspects of law enforcement and military fail to abide by and defer to civil authority, you have a Police State. This may be where we are headed in the United States if citizens do not push back against two recent demonstrations of police disrespect for civil authority and the very representatives of the people that they are supposed to serve and protect.
In Washington, John Brennan, the head of the CIA, engaged in an act off insubordination against the president who hired him in his public responses to the Senate report on American torture practices during the Bush Adminstrtation. In New York, the police led by the president of the NYPD Police Benevolent Association has engaged in an insolent and destructive course of conduct in the wake of the assignation of two New York two patrolmen, Wenjian Liu and Rafael Ramos.
The NYPD is acting in open rebellion against Mayor Bill de Blasio of New York, and the civil power he represents over them. This is an incredibly perilous time for democracy at the most basic levels. The actions of the head of the CIA and the officers of the NYPD are indicative of what I would expect of the security forces of Egypt and not the United States. This behavior is anything but exceptional.
As has been stated by cautious and reasonable observers. "It is very simple. If the CIA is insubordinate to the president, whom the country elected, then it is insubordinate to all of us. If the NYPD runs a slow-motion coup against the freely elected mayor of New York, then it is running a slow-motion coup against all the people of New York. There is no exemption from this fundamental truth about the way this country and its system is supposed to work." "There's and App for That"

In the past couple of weeks several apps have appeared for both the iPhone and Android device that are designed to assist citizens in handling encounters with law enforcement.
The first one Driving While Black or DWB, will be available for the iPhone and Android devices after the first of the year, Driving While Black . DWB was designed by a trio of Oregon Attorneys and provides both common sense and Oregon specific information as to how to best handle Police encounters.
The Stop and Frisk App was designed and developed by the ACLU of New York and deal with the specific issues related to Police encounters on the street and in response to the infamous NYPD stop and frisk policy. The Mobile Justice App was also designed by the ACLU and is available in New York, Oregon, Missiouri, Mississippi and Nebraska.
It should be noted that all these apps train individuals in the best methods in which to comply with law enforcement and how to deescalate situations and encounters as well as assisting in understanding the dynamic of a police civilian encounter from the law enforcement perspective.
I found these apps to be timely and educational and would recommend them, but note the only ones currently available are specific to Oregon and New York. I would welcome any enterprising App developers who would like to work to develop one for Florida.

BOOK CLUB

We are all about literacy here at the Law Offices of James Sweeting III LLC., To that end we are announcing our Saturday Morning Book Club, beginning on Saturday January 10th, 2015 and meeting bi-weekly on Saturdays thereafter we will be hosting a book club to discuss and review books that highlight the legal system and historical trends in our society that have brought us to the present day.
