Department of Labor Issues Final Overtime Rule
As with all government regulations there are limitations and eligibility rules
On May 18, 2016, the Department of Labor issued its well anticipated final regulations regarding overtime rules relating in large part to the exemption of "EAP" (Executive, Administrative, and Professional) employees, which will increase overtime eligibility for millions of previously exempt workers. The new regulations take effect December 1, 2016.

The Fair Labor Standards Act (FLSA) offers protection to all eligible employees covered under the Act in the areas of minimum wage and overtime pay.  Some workers, including "EAP" employees are exempt from that protection. There are generally 3 tests that must each be met in order for the Fair Labor Standards Act "EAP" exemption to apply:

By now, most of us are skeptical when we receive an email from a surprisingly generous Nigerian prince who would love to share his wealth if only we would "advise me send the shipment which cost $49USD only." Unfortunately, scammers are often one step ahead of our information, and every new scam finds its share of victims before people become wiser.  

Scammers these days will be so brazen as to impersonate grandchildren, stalk inboxes for months to devise a personalized cover story, or represent themselves as a vendor or authority that you already work with. Recently, a small music store in St. Paul became a victim of a scheme which cost over $40,000 in a matter of hours through scammers purporting to be QuickBooks (read article). 

With all of this risk and ingenuity, here are a couple best practices to protect you, your loved ones, and your business.

The 990 is a Public Document

The Form 990 is required for charities to file with the Internal Revenue Service (IRS).  The importance of this IRS filing is to document if the organization's operations are in accordance with its exempt purpose and to show if the organization is in compliance with a myriad of IRS compliance and filing requirements. However, the 990 plays a larger role than for the sole purpose of the IRS. Once filed, the form is required to be available to the public and is generally available at GuideStar.com which provides a primary source of information for funders including foundations, governments, corporations and individuals. While the main purpose is to provide information to the IRS, the organization should take great care to ensure the organization's message in the 990 is well communicated.
