EPA Releases Proposal To Revise Certification of Pesticide Applicators Rule
On August 5th, the U.S. Environmental Protection Agency (EPA) releas ed a pre-publication rule proposing stronger standards for commercial and private pesticide applicators who apply restricted-use pesticides (RUPs). The rule will raise the Federal standards for applicator competency, including testing, certification and continuing education, in an effort to provide assurances that certified applicators and noncertified applicators under their direct supervision are competent to use RUPs in a manner that will not cause unreasonable adverse effects.
The NPMA Policy Team has already met with EPA concerning the proposed rule, and is in the process of discussing the implications with the Public Policy committee and member companies.

NPMA Members Request Overtime Rule Extension on Comment Period
Last week, NPMA's Policy Team sent an alert out to members requesting they submit a letter to the Department of Labor (DOL) requesting a 60 day extension of the comment period on the DOL's proposed overtime rule. If granted, the comment period would be extended to November 3, 2015 and give our industry more time to conduct necessary research. As of August 11, 185 letters had been submitted by NPMA members! We are fighting an uphill battle and every voice counts. If you have not already done so, please click the below link to submitan extension request to DOL.
In addition to letters being sent by NPMA members, NPMA has already submitted a detailed extension request on behalf of the entire industry, an excerpt from the letter submitted by NPMA includes:
"The recent release of the proposed rule revealed a minimum threshold increase of 113%, far in excess of what was believed. The proposed rule leaves more questions than answers and has the potential to significantly change over the course of the rulemaking process. The 60 day comment period is simply too short of a time period to conduct necessary economic analysis and surveys on the proposed rule's impact on the Pest Management industry and the national economy."

Adult Dies of Plague in Colorado
CNN, August 6, 2015
Centuries after ravaging millions, the plague has come to modern-day Colorado -- leaving a devastated family behind, after their loved one succumbed to the disease.
The Pueblo City-County Health Department announced Wednesday that an adult had died from the plague, a disease that has a long and sordid history, albeit not one typically associated with modern times or developed countries like the United States.
The health department didn't detail who died, beyond that it was an adult.
The agency said in a press release that "the individual may have contracted the disease from fleas on a dead rodent or animal." It's the first such case of someone in Pueblo County contracting the plague since 2004.
This highlights the importance to protect yourself and your pets from the exposure of fleas that carry plague," said Sylvia Proud, the city-county public health inspector. Read more...

S. 1500 Passes Senate Committee, Eliminates NPDES Permits
On Wednesday, August 5th, S. 1500 Sensible Environmental Protection Act passed the Senate Environment and Public Works (EPW) Committee. S. 1500 would clarify that federal law does not require the redundant and unfairly burdensome NPDES permits for already regulated pesticide applications. It is NPMA's position that FIFRA approved products require no additional restrictions or additional regulatory burdens due to FIFRA's statutory authority and the detailed pesticide approval process.
S. 1500 should be brought to the full Senate sometime this fall, and while the House has already passed similar legislation, at this point it is unclear whether the President would veto this legislation if it was brought to his desk for final passage.
On Tuesday, August 4th , NPMA sent an action alert to members that live within states of Senators that sit on the EPW Committee. The NPMA policy team would like to thank those members that participated and sent letters to their Senator, and highlight the positive impact those letters had in passage of S. 1500.
