H.R. 644 - FEDERAL LAW PERMANENTLY BANS TAXATION ON ACCESS TO THE INTERNET
On Feb. 24, 2016, President Obama signed into law the amendment to the Federal Internet Tax Freedom Act (ITFA) to
permanently impose the moratorium prohibiting state and local taxation of Internet access and taxation on certain types of electronic commerce. The IFTA was first signed into law in 1998, prohibiting new taxes on Internet access fees and discrimination of electronic commerce. The IFTA originally implemented a three-year moratorium on taxing internet access or imposing discriminatory taxes on electronic commerce, except for certain states that had been grandfathered under the law. The states currently imposing taxation are: Hawaii, New Mexico, North Dakota, Ohio, South Dakota, Texas and Wisconsin. The bill also includes an end date for taxation in these states, which is June 30, 2020.
