ELIGIBLE MANUFACTURING PERSONAL PROPERTY EXEMPTION - FORM 5278 - DENIALS
Form 5278 was due to the local assessor offices by Feb. 22, 2016. Denials are already being received by taxpayers. Assessors are denying the forms (exemption) for various reasons, based on the eligibility requirements of MCL 211.9m, MCL 211.9n and MCL 211.9o. Whatever the reason, the assessor must notify the taxpayer of the denial and their right to an appeal. The denial should be appealed to the March Board of Review (MCL 211.30). Filing a protest with the Board of Review is necessary to protect your right to further appeal an EMPP exemption dispute to the Michigan Tax Tribunal. To protest the denial, contact the local assessor's office to schedule an appointment with the Board of Review. The date for the hearings with the Board of Review is the second Monday in March, so this year the day is March 14, 2016. The assessor's office may have openings on the following Tuesday and/or Wednesday, but contact the office to confirm. A decision on the appeal is not forthcoming the day of the hearing. The decision will be in writing, and is due to the taxpayer prior to the first Monday in June (June 6, 2016). Instructions to appeal the decision (to the Tax Tribunal) will be included in the correspondence.
Also review the current tax assessment to determine if you agree with the amount. With the new forms this year, there may be instances where the calculated amounts are incorrect, which may cause inaccurate assessments. If you disagree with the assessment you received, then schedule a hearing on Monday, March 14th, before the Board of Review.
