Important Tax Information for Multi-State Homeowners    

 

A recent Minnesota Supreme Court case ruled that a taxpayer was liable to file and pay taxes in the state of Minnesota, despite efforts to show that he had changed his residency to Florida. The taxpayer took what he thought was all necessary steps to prove that he was no longer a resident of Minnesota, and therefore not subject to filing requirements in that state. The state came back and ruled that he was indeed still subject to filing in Minnesota based on a few criteria. Taxpayers should be aware of the following factors when determining their filing requirements for individual states:

 

  1. Personal Property - taxpayers should be mindful of any personal property and the location in which it is insured. Even if you do not live in a particular state, if the majority of your personal property resides and is insured in that state, it could indicate domicile in that state.
  2. Bank activity - the location in which the majority of a taxpayer's activity is incurred could be an indicator that the taxpayer has domicile in that state.
  3. Business relationships and professional memberships/clubs - the location of professional services that the taxpayer uses may cause a state to conclude that the state of the professional services and memberships is the state of domicile.
  4. Percentage of time - in the case of the Minnesota taxpayer, even though he maintained a home in Florida, only 14% of his time in a given year was spent in Florida. The remaining time was spent between Minnesota (46%) and traveling to other states (40%). The court determined that this was reason to believe his domicile was still in Minnesota.

 

Although this case was specific to the state of Minnesota and each state's rules may vary, the above criteria are good guidelines to be aware of if you own homes in more than one state.
