President's Message
Thank you to our March meeting host, Walker Zanger, and our Featured Speaker, Chris Hunt of PowerDown, for an excellent Chapter meeting.   We had a wonderful venue delicious food and beverages with  an engaging speaker.  It was another superb Chapter meeting.
  
The majority of the Chapter membership should have received their annual Membership renewal package. We hope that those of you who have not already positively responded have full intentions of renewing your membership, and we strongly encourage you to be sure to renew during April.

 

While we have established some clear goals for the Chapter for this fiscal year, we never want to lose sight of the basic value a NARI membership has to offer our members. There is access to an excellent cross section of LOCAL experts that collectively can give you a good insight as to how the local industry is performing. What better way to keep your finger on the pulse of the remodeling industry than to pick up the phone and reach out to your fellow NARI members.  There are always opportunities to cross promote members' businesses. We want you to continuously find value in your membership.  Some of the real value in membership is by attending Chapter meetings, networking at those meetings, and the educational opportunities that are offered.  Another real and growing value that affects your bottom line is by working with other NARI members. There is increasing value of NARI members working with each other, and that network is continuously growing.

March 2013 Chapter Meeting Recap

 "Reducing Electrical Baseload and Making Your Home Energy Efficient"

 

 

Our sincere thanks and appreciation to Pat McIntosh and the  entire staff at Walker Zanger for hosting a fabulous Chapter Meeting. The  Walker  Zanger showroom provided a wonderful and unique setting and the food and beverages were delightfuly different and  delicious.  A great time was had by all.

  

Chris Hunt's presentation on "reducing electrical baseload and making your home energy efficient" showed the value of conducting residential electricity audits to reduce waste, understand consumption and increase the value of a home.   Chris discussed actual case studies, outlined the techniques used to conduct an audit, and listed product recommendations.  Thanks Chris, for an excellent presentation that was valuable information for our members, guests, and their clients.

 

We look forward to seeing everyone at our Networking Meeting in April at Custom Kitchens by John Wilkins!

EPA Lead Safe Certification
Heightened Enforcement for Certification

 

 

Is Your Company Certified Yet?  

 

The Environmental Protection Agency is stepping up their  enforcement of the Lead Renovation, Repair and Painting (LRRP) ruling. They estimate that only 20% of contractors nationwide have obtained the required lead paint certification.

 

The LRRP ruling requires that firms performing renovation, repair, and painting projects that disturb lead-based paint in homes, child care facilities and pre-schools built before 1978 be certified by EPA and use certified renovators who are trained by EPA-approved training providers to follow lead-safe work practices.   

 

If you work on pre-1978 homes, you must have a Certified Renovator on staff and your firm must also be certified.

 Use of Temporary Employees Versus Leased Workers - Dangerous

Most contractors already know the risks of "casual labor" (curbside hires).  But workers hired from contract labor pools (CLPs) may be "temporary employees" as opposed to "leased workers."  (The generic term CLPs is not to be  confused with the company CLP, a NARI member.)  Few contractors are aware of the exposure created when hiring "temporary employees." 

 

Disclosure:  this is a complicated subject, but very important. 

What is a "Temporary Employee?"  A "temporary employee" is defined as an employee who is the following: designated as temporary by an agency for a definite period of time; performs temporary duties (or permanent duties on a temporary basis); is not eligible for permanent status and; is terminated at the end of the employment period.  In construction, "temporary employees" can be subcontractors and/or or day laborers, although are usually the latter. 

What is a "Leased Worker?"  A "leased worker" is a person leased to you by a labor leasing firm under an agreement to perform duties related to your business.  While they do cost more per hour than a full-time, non-leased hire, they also require substantially less legwork as there is no need for resume screening, interviews or the paperwork associated with hiring new employees.

 

The standard commercial general liability (CGL) policy clearly states an employee includes a "leased worker" but not a "temporary employee." 

 

The Difference.  A "leased employee" is covered under the employer/General Contractor's General Liability insurance, cannot sue the employer/General Contractor, (if the proper Alternate Employer/waiver of subrogation endorsement is in place) and the fellow employee exclusion does not apply.

 

With a "temporary employee," it is the opposite; not covered by General Contractor's Commercial General Liability policy, and they can sue the employer/General Contractor.  Damages caused by a "temporary employee" would be paid for out of the contractor's pocket. This can be quite substantial.

 

But Really: How To Tell the Difference?  If you have an arrangement using a staffing company, read the contract very carefully and determine if they are furnishing "temporary employees" or "leased employees."  It should say.  It's just that simple. Once you know, you'll know what to do.

 

The Problem Under the CGL Policy.  Under the CGL policy, there is no coverage for bodily injury/property damage caused by a "temporary employee" while working for the client/General Contractor.  Under the CGL a "leased employee" is covered for injury or damage to someone/something.  Workers' Compensation is the primary source of any bodily injury to the "leased employee" worker as long as the proper Alternate Employer endorsement is in place. 

 

Also, the "temporary worker" does not fall under the employee exclusion.  The "temporary worker" could sue their temporary employer for bodily injury under its temporary employer's General Liability policy and collect pain and suffering.  And he/she can also sue for lost wages. 

 

Normally, under the contractual liability coverage in the CGL, a General Contractor would have coverage if their own employee sued the customer/client/homeowner of the General Contractor for their injuries if the General Contractor has signed an indemnity clause in favor of the customer/client/homeowner. For this coverage to be available to the General Contractor, the injured person must qualify as an employee (a "temporary employee" does not).  

 

The General Contractor's Options.  These exposures must be considered unacceptable under standard risk management practices.  The contractor has two options:  

  1. Don't use a "temporary employee" staffing company; use only "leased employee" staffing companies; or
     
     
  2. Require the "temporary employee" staffing company to comply with several items that will change the staffing company's relationship to that of a subcontractor. 

Amend the Contract Used by the "Temporary Employee" Staffing Company.  The usual un-amended contract used by the staffing company will typically have an indemnity clause in favor of them.  It is of no surprise that the staffing companies, for temporary, leased, or both, use an indemnity clause in their favor so as to try and trigger the CGL of the General Contractor.  Very few people understand how clever this is; I'm sure the staffing company's insurer is very pleased with this strategy. 

 

Change the clause to favor the General Contractor; it is then possible for the contractor to access the liability policy of the staffing company under the Contractual Liability coverage.  This is valuable in the event that the insurer of the staffing company denies defense/indemnity under an additional insured endorsement. 

 

Have a Separate Subcontract with "Temporary Employee" Staffing Company.  Further, there should be a separate subcontract between the General Contractor and the staffing company.  This subcontract must include clearly outlined insurance requirements in order to trigger the coverage held by the staffing company. Many of the insurance forms used today are written on a "blanket" basis that mandates the insurance requirements be included in the agreement between the two parties.  If insurance requirements are not stated, the insurer can/will deny coverage to the General Contractor for defense/indemnity. 

 

List of Insurance Requirements Needed to Mitigate the Risk of Hiring a      "Temporary Employee."  Have a subcontract executed by competent counsel.  Change the status from "temporary worker" to subcontractor. The subcontract needs to include the requirements for additional insured status under their CGL, along with an Alternate Employer/Waiver of Subrogation endorsement from their WC carrier. Also, an indemnity clause in favor of the General Contractor is necessary and important.

 

Conclusion.  This use of these available risk management solutions is common sense.  But it is up to the contractor to see that it gets done.
