The Chapter's Leadership conducted our annual Strategic Plan ning Meeting on February 2. This meeting also served as an introduction to our new Board members. Big thanks to Chip Doyle of Sandler Training, who presided as the Facilitator during the meeting. He did a great job of keeping the meeting lively and on track. One of the main goals of the Strategic Planning Meeting was to focus on Committees. We worked on identifying Chapter members that would be interested in serving on a Committee. We have been very successful in generating a lot of interest, and we are working to finalize Committees for this year. A big thanks to Tim Faller of Field Training Services for his presentations on February 13, both at the educational workshop at Truitt & White and the evening program at Rejuvenation. Tim Faller Seminar & Evening Presentation A Great Success
Our sincere thanks and appreciation to Rob Wien and the staff at Rejuvenation for hosting the February 2013 SFBA NARI Chapter meeting on Wednesday, February 13. We had a full house for both the seminar and the evening Chapter meeting. Rejuvenation has a great showroom with lots of wonderful items. We thank them for an excellent meal and beverages and for all their hospitality in hosting our meeting.
Ou r deep appreciation to Tim Faller, Principal of Field Training Services, for his excellent seminar on "Managing the Job Site for Efficiency" and evening presentation on "Managing People: A Fresh Look". We thank Tim for making time in his schedule to visit the West Coast and make his presentations to our Chapter members and guests!

Is Your Company Certified Yet?
The Environmental Protection Agency is stepping up their enforcement of the Lead Renovation, Repair and Painting (LRRP) ruling. They estimate that only 20% of contractors nationwide have obtained the required lead paint certification.
The LRRP ruling requires that firms performing renovation, repair, and painting projects that disturb lead-based paint in homes, child care facilities and pre-schools built before 1978 be certified by EPA and use certified renovators who are trained by EPA-approved training providers to follow lead-safe work practices.
If you work on pre-1978 homes, you must have a Certified Renovator on staff and your firm must also be certified.

NARI remodelers more successful than industry norm
Research reveals business sophistication level of NARI members
Des Plaines, Illinois, February 19, 2013-Members of the National Association of the Remodeling Industry (NARI) continue to lead the industry in terms of sales, production and employees, according to results of the 2012 NARI Member Profile Study, conducted by Fred Miller, president of Consumer Specialists.
The data-designed to provide a snapshot of NARI remodelers-shows slight growth in the number of company locations, in-house design work, dedicated salespeople and types of services offered.
"NARI members are quite adept at diversifying and adapting to market trends in order to remain successful," says Tom O'Grady, CR, CKBR, chair of NARI's Strategic Planning and Research committee and owner of O'Grady Builders in Drexel Hill, Pa. "The research suggests the majority of NARI businesses are operating on a sophisticated level, with ongoing evaluation of revenues, sales margins, overhead, income, performance, shifts in housing and consumer demands as the basis for decision-making."
This year's data shows other signs of improvement in the remodeling industry:
- NARI members reported a 14 percent boost in average sales, with 38 percent reporting more than $1,000,000 in annual sales.
- Eighty-two percent (82%) of NARI members offer more than one remodeling service.
- NARI members reported an increase in number of employees, with a 3 percent uptick in dedicated sales employees.
"Though the recession took its toll on many small businesses, NARI members seem to have prevailed," O'Grady says. "Many of us are taking time to refresh our operations and responsibilities in preparation for growth over the next couple of years." In fact, 93 percent of NARI members predict future sales to be as good or better in 2013, according to the Member Profile data.

Heads Up: What To Do When You Are The Second Contractor On A Job

[Author's note. I wrote the original versions of this article in 2003 - for NARI and then a later version for the Journal of Light Construction. It is the most popular one I have written. I frequently send it to clients who are "the second contractor." So, while I work on a longer article for next month, this topic - somewhat revised - is appropriate to revisit.]

Common sense. With the economy and construction picking up, there have been more and more instances where my general contractor clients have been asked by homeowners to continue or complete jobs that were started by other contractors. In most cases the original contractor had been fired. I tell my clients there are some common sense precautions they should and must take before they agree to finish another contractor's project.
What is the problem? Figure out what the problem was with the previous contractor. If the problem was clearly due to his incompetence or a personality clash with the homeowner, consider taking the job. But if the problem had to do with the client and/or architect, you are perhaps better off turning the job down. After all, history does repeat itself.
Is there a dispute - and are any attorneys involved? Be sure to ask both questions. There can be a dispute without attorneys, and attorneys can be involved in the absence of a formal dispute. If the answers are no disputes and no attorneys, splendid - go onto the next point in the checklist. If the answer is yes, then you need to find out more.
In the vast majority of disputes there are not only two sides, but the truth is usually somewhere in the middle. One of the big red warning flags is non-payment by the owner. Carefully inspect the previous work. If the work seems acceptable and the owner is merely stiffing your brother contractor, take a pass.
Ask for and look at the previous contract. This is a corollary to the above point. As part of your due diligence, ask to see a copy of the first agreement. This will help you find out if your deal is the same - or not. And if it's not the same, figure out what's different and why.
Is there an architect? This is not a silly question. These are the days of design/build and frequently there is not an architect involved. But if there is, you need to meet with him and/or her. Get a read on their competence and personality.
Create a record. If you conclude it was the first contractor who was the problem and wish to take the job, don't buy into his work (and problems). Create a comprehensive and definitive record of the crime scene before you start. This would include photographs and lots of them. And LOOK at them; it's amazing how these are not the great and requisite records you thought they were when you look at them months later. Indeed, I had one recent case where none of the photographs came out, but my GC didn't know it until the eve of his mediation. As a consequence, we spent a lot of time re-constructing records that we hoped would pass muster.
Amend your contract. Your contract with the homeowner should include a specific provision to protect you in the event you are drawn into a dispute between the first contractor and the client. It should provide that you are compensated for your time and trouble if you are required (by subpoena or otherwise) to give testimony at the future mediation, arbitration or trial, required to produce records, or otherwise be involved with the dispute. There are circumstances where you can literally spend days getting hammered in deposition or trial and not get paid for your time unless you have contractually protected yourself.
Check with your attorney. It goes without saying that you inform your attorney what you are doing so that he or she may be in the loop and perhaps suggest yet other ways to protect yourself.
Talk with your insurance carrier. This is more than a mere courtesy - surprisingly wise things sometimes come from the mouths of your insurance agents or brokers. One example: in California many urban contractors are insured for remodel and renovation work but for not new construction. Thus a contractor who is taking over a new construction project would have to get a new and different coverage. And the cost of such coverage should be plugged in as part of the job cost. These are tough times in the insurance marketplace and the cost of this new coverage might be so high as to be prohibitive. This is important information to have before the contract is signed.
Conclusion. In summary, be smart. Don't be reluctant to take a pass on a job that doesn't make sense.
