Our sincere thanks to Bill Essert of Wooden Window for hosting the January Chapter meeting. Also, we would like to acknowledge and thank Judith Clark, FIFDA, CID for her presentation is on iPad Applications for the Design Trade. Judith had a lot of good information that is beneficial for our industry as we move further and further into a paperless society. We hope everyone enjoyed the evening.
As a reminder,our Chapter's Leadership will be conducting a Strategic Planning Meeting this Saturday, February 2.This meeting also serves as an introduction to our new Board members.Chip Doyle of Sandler Training will preside over the meeting as Facilitator. Our Chapter is fortunate to be served by 13 talented Board Members, 11 returning and 2 new, who represent a great cross section of our industry. They all bring fresh ideas and energy.The focus of our meeting will be to empower the Committees for the important role they play in our Chapter's success.Membership, including membership retention, will be a key element.

This hands-on workshop looks at the complete project cycle, beginning with early stage planning including economic and market analysis through execution of work with a team of contractors and building trade specialists.
The California Hotel in Oakland was once one of biggest attractions for jazz artists on the West Coast, but by the 1980s, it fell on hard times. Now near completion, planning for this project began over 5 years ago to determine the viability of rehabilitating this National Register property for use as low-income senior housing. Join us for a unique presentation that explores the rehabilitation process from beginning to end. Discussions will include financing and market considerations, documentation, structural and technical challenges and unique up-close observation and participation in the final stages of construction at the site.

Electronic Formatting of Home Improvement Contracts CSLB Compliant Or Not?

A general contractor client of mine recently contacted me regarding his wish to do his home improvement agreements electronically. His concern (echoed by many): having a Business and Professions Code/CSLB compliant contract makes the document of some length. And this tends to be a problem, especially with smaller jobs; "You want me to sign a 15 page contract for this $13,000 job?"
My contractor's excellent idea was to make his homeowner transactions entirely electronic, allowing the full agreement to be viewed electronically by the homeowner, and - after necessary customization - electronically signed by the parties. It could then be easily printed as a PDF hard copy by the homeowner and/or if desired.
A number of industries and professions already now conduct all of their transactional business electronically, so the notion made some sense. If there was any uncertainty, my client's fall back position - could perhaps part of the agreement be viewed online and part hard copy? (The logical online piece would be the boilerplate general conditions and the statutory verbiage of the longer notices.)
My first thought was (of course), "Would this meet the Board's compliance requirements?" Intrigued, I went straight to the source - the Contractors State License Board. Indeed, I sent my questions to David Fogt, CSLB Chief of Enforcement. Mr. Fogt has proved himself cordial and available to contractors. Indeed, in September 2011, Mr. Fogt spoke at the monthly SFBA NARI meeting.
Response from the CSLB Chief of Enforcement David Fogt. Within two weeks of sending my letter, I received the following response from Mr. Fogt:
"Dear Mr. Byrnes:
The content requirements for home improvement contracts are specified in Section 7159 of the California Business and Professions Code. Among many other requirements, Business and Professions Code Section 7159 mandates "a home improvement contract and any changes to the contract shall be in writing and signed by all parties. It is the position of the Contractors State License Board that compliance with this portion of the statute requires and actual printed, paper document.
The proposal that a home improvement could be prepared with a portion printed - presumably with signatures - and a portion digitized in intriguing. It is conceivable that such an approach could be used in the future while still ensuring proper protection of consumers. However, it is the Board's opinion that any substitution of digitized format for a printed document would require enabling legislation, and we are not aware of any industry efforts towards that end.
The requirement for a written document probably seems archaic to some, including your client. For the time being, however, I am afraid your client should continue to print all home improvement contracts and obtain written signatures to remain in full compliance.

That is the entire letter. Who says governmental workers can't write clearly and concisely?
Conclusion. This was a splendid idea, but before its time. And stay tuned, for this will change. But until further notice, all home improvement contracts must be an actual printed document with real world written signatures from the client.
