you may have heard fore! shouted a few times. Our 7th Annual Golf Tournament was a great success. Although weather conditions were less than ideal, everyone enjoyed playing golf and interacting with all the different sponsors located throughout the course.
Congratulations to the winners of the tournament, Doug Dow and Team California Closets. This group is headed for the PGA Tour! A tremendous thanks to Golf Tournament Director, Adam Haedt, for orchestrating this event and also to our Club Pro Sponsors Cambria USA and Stone Etc., led by Deborah Greene and Natalie Raya, respectively. During the evening, we all enjoyed the music of JazKatz, and the raffle prizes were incredible with three custom bathroom vanities being donated by Cambria USA and Stone Etc.

I would encourage members who have submitted projects to consider the following: 1) Invite your clients who you believe would appreciate having their projects recognized; 2) Bring your employees who worked on these projects as another way of acknowledging their contributions; 3) Bring other team members who were critical to the outcome of the project such as architects, designers and/or contractors. The REMMIES is a special event and an excellent way of reflecting back upon the success of the work you have completed, acknowledging the parties that were involved in the outcome, and projecting forward to how you can successfully market your recognition!
In our last President's message, we recognized a new member that had submitted her candidacy for the Chapter's Board of Directors. We would like to continue that acknowledgement this month with another member, Doug Coe, who has submitted his candidacy for the Board of Directors. We continue to encourage new and existing members to get involved in the Chapter. With the new Board and Officers that will be sworn in at the REMMIES/Leadership celebration, the new leadership team will quickly determine how they will lead the Chapter going forward in 2013. There will be plenty of opportunities for members to participate within the different Committees. Please join us and share your ideas and creativity.

7th Annual SFBA NARI Golf Tournament Recap | | |
7th Annual Tourney A Big Success
The 7th Annual SFBA NARI Golf Tournament was held on Thursday,
October 11, 2012 at the Metropolitan Golf Links in Oakland CA. Many thanks to Deborah Green and staff of Cambria and Natalie Raya and staff of Stone Etc., our Club Pro Sponsors, for their assistance in making the Tournament a big success.
A big thank you also goes out to our Par, Table Top, Mulligan, and Custom Sponsors for their support of our Tournament. We would not be able to host such a successful event without the support of all of our Sponsors.
Despite the cold and blustery weather, we had 75 golfers participate in the Tournament. Congratulations to Doug Dow and Team California Closets for their first place win again this year. They are the team to beat!
After the Tournament, golfers were joined by other NARI members and friends to enjoy a wonderful bbq dinner, jazz stylings by Bill Essert and his JazKatz band, and a fantastic raffle! Custom vanities were among the fabulous items that were given as raffle prizes.
Our thanks also go out to the Metropolitan Golf Links and to the Wedgewood Catering & Banquet Center for hosting our event again this year.
A great time was had by all.

NARI Survey for Title 24 Training Needs | | |
2012 California Building Energy Efficiency Standards - Title 24, Part 6
NARI has been contacted by McLain ID Consulting, a company that specializes in training needs analyses, about a survey they are conducting-under the auspices of the Public Utility Commission-to determine what kind of training would best meet the needs of building contractors and tradespeople in light of the upcoming 2013 California Building Energy Efficiency Standards (Title 24, Part 6).
By participating in this survey (which will take about 10-15 minutes of your time), you would be helping them focus in on the best way for you to receive the information and training you may need to understand and comply with current and upcoming code.

NARI Member Benefit - Home Depot Rebate Program

NARI has a great new program that can earn money for you! A s you may know, NARI has a relationship with The Home Depot. We want to leverage this relationship to put money back in your pocket.
As part of the program, you can receive a 2% rebate based on purchases you make at The Home Depot. All NARI members in good standing are eligible for this rebate. The 2% rebate is paid by The Home Depot directly to you twice per year. In order to begin earning your rebate, you must be enrolled in the program and then register the accounts you use or plan to use to pay for items at The Home Depot (i.e. credit cards, checking accounts, and keytag accounts). To make it as easy as possible for you to take advantage of this rebate, we have put together three simple options to get enrolled and register your accounts:

- Follow the on-screen instructions or refer to the Program Enrollment Guide (link is below).
- Call the toll free number (866) 333-3551, and a Home Depot Support Center associate will enroll you and register your payment information (their support center will call this "tenders"). Please be sure to tell the representative that you are in the NARI Program.
- If the Home Depot Support Center has not received a call from you and you are not enrolled nor registered any tenders, they will call you to complete the enrollment process!
Home Depot - NARI Member Registration Guide
We wanted you to know about this process so you could register immediately and start earning your rebate. This is one of the most valuable benefits you receive as a NARI member, so if you have not completed steps 1 or 2 as outlined above, you should expect a call from The Home Depot Support Center team. If you receive a call from The Home Depot Support center, you should know:
- The representative will tell you they are calling about the NARI rebate program
- They will ask for your company name, address phone, email etc.
- They will give you a user name and password
- They will ask to register your "tenders". This means that they will ask you for the credit card, checking, and keytag account numbers you currently use or plan to use at The Home Depot.
In order to ensure you are speaking with an authorized account representative, please ask them for the verification code. The code is "NARI402". This is for your protection, so you can feel safe providing this information over the phone. It's your verification that they are authorized to call you.
Once the code is confirmed, you know that you may safely share your credit card information. The representative will not ask you for the "CID" number on your card so do not share that information.
All credit card and bank account information is immediately encrypted by the system. It is stored and accessed by processes that are audited and compliant with PCI (Payment Card Industry) standards for security and privacy so your information is safe.*

In a recent homeowner/contractor dispute, my client was the hom eowner. Several interesting questions were raised. First, can a Class "C" specialty contractor perform work outside of its licensing classification? And second, what are the consequences when a contractor fails to obtain necessary permits?
While these are certainly not new or unique issues, urban myths abound and people still tend to be confused about them.
What Happened. In this particular situation, my homeowner client hired a contractor to perform electrical work on his home. In addition to performing electrical repairs, the contractor also replaced seven windows. (Go figure.) The contractor also did not take out a permit. Shortly thereafter, the windows began to leak.
Can A Contractor With A "C" License Perform Work Outside Of Its Licensing Classification?
Pursuant to Business and Professions Code Section 7058, a specialty contractor - a person with a Class "C" license - is defined as "a contractor whose operations involve the performance of construction work requiring special skill and whose contracting business involves the use of specialized building trades or crafts." (As most of you know, there are 41 separate "Class C - Specialty Contractor" licensee classifications. Some of them are as wonderfully arcane as glazing or ornamental metal.)
Pursuant to Business and Professions Code Section 7056, a general contractor is defined as "the principal business is in connection with any structure built, being built, or to be built, requiring in its construction the use of at least two unrelated building trades or crafts. A general building contractor may take a contract for projects involving one trade only if the contractor holds the appropriate specialty license or subcontracts with a licensed specialty contractor to perform the work."
When licensed contractors work outside of their specific classification or scope of work, they subject their license to possible disciplinary action and/or criminal charges from the Contractors State License Board. Further, doing work outside of one's classification can be considered by the homeowner as a breach of contract by the contractor - for the failure of following state and local laws.
Conclusion. In my case, replacing windows clearly is not within the permitted scope of work for this contractor. If you hold a Class "C" license, be careful if and when doing work outside of your classification. You could not only face fines and/or discipline by the Board, but also a claim by your client.
What Are The Consequences When A Contractor Fails To Obtain The Required Permits?
In the above scenario, my homeowner contracted a second contractor to repair the defective work of the previous one. When applying for the required building permits, the building department noted that no permits had been pulled on the property for over two decades - so certainly not by the first contractor. In order to obtain the permits for the current work, the second contractor had to submit a complete set of drawings, including floor plans site plan, title 24, etc.
Thus, what should have been a routine application for permits turned into a complete mess. Not only was the second contractor required to do more work, but the homeowner had to pay more, including penalties. This of course also delayed the start date of the repair project significantly.
Building permits are required by law as a public safety measure; they ensure that construction is performed in compliance with local and state codes. When a contractor performs work/improvement that requires a permit but fails to obtain a permit, it is a violation of Business and Professions Code Sections 7110 and 7090. As such, they are subject to disciplinary action by the Board, including civil penalties, an order of correction to pay the cost of permit fees, and any assessed penalties by the local building departments.
Consumers can now complete a "Permit Violation Form" on the Contractors State License Board website. Once received, the Board will contact the contractor regarding the allegation and take the necessary action.
Once again, a failure to obtain permits can again be considered by the homeowner as a breach of contract. And please note: homeowners can not waive the need of a permit.
Conclusion. I am mindful that obtaining permits - or not obtaining permits - can determine whether a contractor gets the contract. But keep in mind when wrestling with this issue: that the buck always stops with the contractor if something, anything, goes wrong.
