How Does The
Universal Accreditation Act Affect You?
 
The Intercountry Adoption Universal Accreditation Act of 2012 (UAA), goes into effect on July 14, 2014. All agencies or individuals that provide intercountry adoption services must be accredited by the Hague Adoption Convention.
 

There is one exception to this rule. You can operate as a supervised provider of adoption services as long as you are working under a Hague primary provider.

If you chose to operate as a primary provider over a supervised provider, you will be increasing your exposure to a potential claim due to taking on the liability of the supervised agency as their primary provider.

 

Unlike Hague accredited agencies, domestic placement and/or home study agencies are not required to carry insurance. This means your policy would be primary even in the case of the supervised agencies negligence.

 

As a primary provider, there are a number of ways to protect yourself:

 

1. Only work with a supervised agency that carries at least one million in Professional Liability (not General Liability).

2. Be named as an 'additional insured' on the policy.

3. Require that the 'additional insured' wording includes a 'Hold Harmless' clause and a 'Waiver of Subrogation' clause.

 

As the UAA goes into effect, you should take into consideration any additional exposures you may encounter as a primary provider.

Phil Hawley, President of Hawley & Associates was interviewed once again on Voice America Radio on the 'Your Adoption Coach' show with Kelly Ellison. The air date was April 26, 2014.

 

Phil talks about wrongful adoption and claims resulting from the failure to disclose information about an adoptive child, whether it be intentional, unintentional or negli-ligence.

 

He also discusses why it is so important for an adoption agency to have the proper insurance coverage to protect their agency from any wrong-ful adoption lawsuits.

State Unemployment Insurance Alternative for 501(c)(3) Non-Profits

 

In 1972 the Federal Unemployment Tax Act was amended, giving 501(c)(3) non-profit organizations the ability to opt out of State Unemployment Tax programs and instead reimburse State Unemployment programs for their actual paid unemployment benefits.

 

Hawley & Associates is proud to serve 501(c)(3) non-profits and offer this ever popular insurance alternative. By electing to be a self-payer of the organization's unemployment claims is almost always less costly than paying standard unemployment taxes, freeing up valuable funds for the organization's programs and services. In many cases, the savings can be 30-40 percent. Organizations with a payroll of at least $1,000,000 are the best fit for this program.

H&A Attends the
NCFA National Adoption Conference
Orlando, FL.- June 2014
  
Phil Hawley and T.J. Armstrong of H&A were excited to sponsor and be part of this year's NCFA (National Council For Adopton) National Adoption Conference, which took place in Orlando, FL. 
  
It was a great turnout this year and a great opportunity to showcase our services and products. We were also able to get some invaluble face to face time with many of our clients!
  
Phil was honored to be a presenter and panel member discussing the topic of Universal Accreditation and how this Act it will affect adoption agencies going forward. 

Hawley and Associates also hosted an 'open house' reception one evening during the conference.  We had a great turn out and everyone enjoyed the food, libations and the amazing fireworks show from Epcot Center!  Thank you to everyone who attended and making the event a great success!
  
H&A, in partnership with the NCFA, was proud once again to present the H&A Caring Fund Grant for 2014 in the amount of $5000.00.  The grant was open to all conference attendees. All applications recieved are currently in the review process.  A decision will be made at the end of September 2014.  Stay tuned for updates!

Odyssey House's Annual Fundraiser
Salt Lake City, UT - June 2014 
  
It was an honor to sponsor and be a part of Odyssey House's "Summer Fling" annual fundraiser, in Salt Lake City, Utah.

 

Odyssey House is a non-profit substance abuse treatment facility located in Salt Lake City, Utah. They specialize in helping individuals and families reclaim their lives through effective substance abuse treatment, prevention, and mental health services.  Odyssey House has served the Salt Lake City area for over 43 years.
 
The fundraiser was held at the Salt Lake City Country Club.  It was a beautiful location and they were blessed to have a gorgeous sunny day!
 
The silent auction items were amazing, including many local attractions and events, themed gift baskets, artwork and jewelry. It was fun to see the feverish bidding happening all around...and all for such a great cause!
 
They had several guest speakers, including Adam Cohen, the Chief Executive Director of Odyssey House, and families who's lives have been touched by Odyssey House and their addiction treatment programs.
 
Hawley & Associates is proud to be a part of Odyssey House and their mission of helping make a difference in so many lives.
