Please take note of an important industry change impacting the time allowed to notify carriers of a potential LTL concealed damage claim.  The National Motor Freight Classification (NMFC) has released a supplement mandating a drastic reduction in the time allowed to notify LTL concealed damage claims by 10 days.
 

All LTL shippers & receivers now have only five (5) business days, down from the former 15, to provide written or verbal notification of concealed damages to the carrier of record.   This timeline is strictly based on notifying the carrier of any concealed damages within 5 business days of the product delivering, not for filing the freight claim.  Failure to provide this timely notification will result in your inability to file a freight claim.

 

Carriers and other transportation companies who use or refer to any provisions of the NMFC are required to participate in the Classification, as noted on the NMFTA website.

 

If you discover any concealed damage (damage which you did not notice at first, or was hidden from your sight), please take the initial steps below:

  • If concealed damage is discovered after delivery, request inspection from the delivering carrier AT ONCE and save all packaging materials until inspection is made.
  • Do not move the product from its original delivery location.
  • Take pictures and document the damaged freight
  • HPFi will assist the consignee (receiving party) in filling a claim with the transportation company (e.g. providing copies of any needed documents,) but the claim must originate with the consignee.

To reiterate, you now only have five (5) business days from receipt of your freight to report any concealed damage claims on LTL shipments.
