Jules Gaudreau NAIFA LEGISLATIVE UPDATE:

Statement from NAIFA President Jules Gaudreau on the DOL Fiduciary Rule

The Department of Labor on April 6 issued its final fiduciary rule that will affect advisors in the retirement planning space and their clients. NAIFA is in the process of reviewing and analyzing the rule to determine exactly how it will impact NAIFA members and will make that analysis available as soon as possible.

NAIFA President Jules O. Gaudreau, Jr., ChFC, CIC, issued the following statement on the DOL rule:

"NAIFA members and others within the insurance and financial services industry worked diligently with the Department of Labor to address many concerns we had with the DOL's draft rule," said Jules Gaudreau, president of the National Association of Insurance and Financial Advisors. "We appreciate that DOL has accepted many of NAIFA's suggestions and reworked some portions of the rule to address concerns raised during the review process."

"We remain cautious, and it remains to be seen how the practical application of the rule will affect middle-market consumers who need retirement planning advice and services. But we are pleased to see, for example, that DOL has incorporated our suggestions on the effective date of the rule, grandfathering of existing clients, and timing of when signatures are required on best interest contracts.

"NAIFA is in the process of completing an in-depth analysis of the rule and will continue to provide training and education to help our members deal with the rule's new requirements and restrictions, We will educate our members and use our grassroots advocacy strength to push for legislation that would best serve consumers.

"This is a crucial issue for us. There is a retirement crisis brewing in our country with large swaths of the population financially unprepared for the future. We need to find a way to continue to provide advice and support for those who are trying to ensure the financial security of their families."

Kevin Mayeux Take Advantage of NAIFA's Nationwide Consumer Campaign!

Addressing the Retirement Crisis

A recent article in the Los Angeles Times highlights the severity of the retirement crisis facing many Americans today and underscores the urgency of the Consumer Retirement Crisis Campaign launched recently by NAIFA. As American workers become increasingly insecure about their ability to save for a traditional retirement, NAIFA earlier this year launched a "Trust a NAIFA Advisor" ad campaign, designed to tell consumers that as they look for ways to address their retirement shortfall, affordable and informed financial advice is well within their reach. The multimedia campaign includes video, print and web placements to urge consumers to plan for retirement by contacting a NAIFA member.

The Los Angeles Times article by Michael Hiltzik selected six charts from the collection of economist Monique Morrisey with the Economic Policy Institute. The charts point out the following:
  • Savings have plateaued. Mean, or average, retirement accounts for all households have stagnated since the recession, Hiltzik writes.Many families do not have any retirement cushion. In truth, Hiltzik points out, nearly half of all families have no retirement account savings.
        
  • Defined-contribution plans like 401(k)s are heavily skewed toward the wealthy. Sixty-eight percent of the richest fifth of households participate in a plan, compared with only 4 percent among the lowest-income fifth, Hiltzik notes.
        
  • The imbalance in 401(k) participation is making income inequality worse. "The top 20 percent of working-age families receive 63 percent of income and hold 74 percent of retirement-account balances," Morrisey notes.
     
  • The disaster of the Great Recession is not a memory for the average family. "Declines in the net worth of older families since 2010 are especially worrisome since they have less opportunity to make up losses before retirement," according to Morrissey.
       
  • Social Security remains the bulwark of retirement for low- and middle-income seniors. The program remains the largest single source of income for seniors with household income of at least $30,000, Hiltzik writes.

These are some of the troubling issues that prompted NAIFA to launch the campaign. Video and print ads direct readers to a web page that includes a link to NAIFA's "Find an Agent" tool, where users may search for a NAIFA member by name, state or zip code. A second search filter allows users to find members by products and practice specialty. The campaign also incorporates digital ads for use on social media platforms, and Search Engine Marketing (SEM) via a Google ad word/phrase buy of more than 200 keywords related to insurance and financial advice.

If Insurance Is Your Profession, Then Politics Is Your Business

When I first entered the insurance and financial services industry, I didn't grasp the gravity of the legislative challenges the industry faces every day on both the federal and state levels. Whether it's fighting for our place in the advisory world, overcoming misconceptions about our professional integrity or advocating on behalf of our clients to ensure they have access to affordable services, I was na´ve, to say the least.

After about a year of being a NAIFA member, I was asked to contribute to IFAPAC. I did. Not because I fully understood what the PAC accomplished for us, but because I respected the person who asked me. Later that year, I attended the NAIFA-Montana State Convention and met our state lobbyist for the first time. That introduction to the world of politics forever changed my passion for the industry. That was the moment when I began to understand that our power is about educating lawmakers.

In 2013, I attended NAIFA's first Congressional Conference in Washington, D.C. I wanted to learn about the process. I wanted to see grassroots efforts in action and see if they were effective.

At the conclusion of my first Capitol Hill meeting, I discovered that my member of Congress was an ordinary person. He had a family and a business back home-just like me. I realized that he-just like me-could not possibly have expert knowledge about every subject on which he would have to cast a vote-and that included our industry.

As an individual constituent, my voice can only have so much sway with my members of Congress. That is why IFAPAC has played a crucial role in my passion for NAIFA. IFAPAC provides agents and advisors with a strong and unified voice on Capitol Hill. IFAPAC is a critical tool in our efforts to protect the industry from harmful legislation. IFAPAC gives all NAIFA members the ability to educate Congress and our state legislators about the impact that proposed legislation, or regulation, will have on consumers, financial services professionals, insurance agents and the economy as a whole. For these reasons and more, I contribute monthly to IFAPAC and make additional contributions at national and state association meetings. More importantly, I try to spread the word about the significance of IFAPAC to my fellow NAIFA members and commit to regular grassroots activities with my members of Congress.

I'm a YAT and I love what I do. I want to make sure I can still do what I love 30 years from now. But I can't do it alone! All NAIFA members must be active. Won't you join me?
