Georgia Challenging Federal Clean Water Rule

Georgia along with eight other states, filed a lawsuit in the federal court in the Southern District of Georgia on June 30 aiming to strike down the U.S. Environmental Protection Agency's (EPA) clean water rule. The suit claims the rule unlawfully expands the federal government's authority over local waters and land use management. The Attorney General of Georgia Sam Olens claims the rule is an overreach of the rights of the States outlined in the terms of the Clean Water Act and the Supreme Court decisions interpreting the Act.

The released complaint claims the rule provides the federal government with "virtually limitless power over non-navigable, intrastate waters."  According to the complaint, the rule will significantly reduce the State's primary authority to regulate and protect water under the state's standards which could impose harm on the States and their citizens.
