2013 MINNESOTA LEGISLATIVE UPDATE FOR CONSTRUCTION INDUSTRY

The Minnesota Legislature is in the middle of its 2013 session of this legislative biennium. Any bills that have not passed out of their second committee are "dead" for this legislative year. However, as we have seen many times before, nothing ever really dies that cannot be revived by attachment to or replacement of another piece of surviving legislation. Session ends May 20, 2013. Until then, we must remain vigilant.
A number of active bills affecting the construction industry remain viable. Here is a list of those as well as ones that have failed to meet their deadlines.

SUING SOMEONE? GET SERIOUS

The decision to commence a law suit has always involved legal, moral and financial considerations. Starting this Summer, the implementation of a few new Rules of Civil Procedure for Minnesota District Courts will cause us all to consider further.
The first of the new rules we will discuss is Rule 1of the Minnesota Rules of Civil Procedure (this seems appropriate!).

NEW LEGISLATION
Many of our contractor clients have questions about the EPA RRP rules. This column hightlights pertinent questions from the EPA's Frequently Asked Questions and provides some further analysis of the answer.
Home builders and owners welcome the new legislation in Washington D.C., which will improve the Environmental Protection Agency's (EPA) Lead: Renovation, Repair and Painting (LRRP) rule.
The LRRP has been under debate since 2010.
