Annual Conference Hotel Reservations
|
The 2015 NACO Annual Conference will be held in Kearney at the Younes Convention Center. The conference dates are December 9th through the 11th.The Kearney Visitor's Bureau has a webpage designed specifically for conference information as it becomes available through the planning process. Rooms have been contracted at the Wingate inn, the Hampton Inn, the Holiday Inn, the Holiday Inn Express, the Comfort Inn and the Fairfield Inn for $99.95 per night for single and double rooms and suites are contracted for $149.95 per night.
You must phone the hotel of choice to make reservations stating that you are attending the conference to receive the group discounted room rate. Only guaranteed reservations will be accepted. Reservations must be guaranteed with either a credit card or by direct billing back to your county. PLEASE NOTE: Reservations may be made initially under the county name but must all have individual names of who will occupy each room no later than November 10, 2015. Any reservation being held under the county name after this date will be cancelled. Training to Better Serve Veterans

The Nebraska Association of Local Health Directors (NALHD) are supporting and coordinating 5 No Wrong Door trainings across the state (see attached flyer for dates and locations). These trainings have been developed by the multi-disciplinary Veteran's Brain Injury Task Force over the past several years to give community members from a range of professions/organizations a solid understanding of issues that Veterans, service members, and their families/loved ones face. The training also gives participants resources and strategies they can use to serve Veterans, service members, and their families better. To view their flyer to obtain more information, click here. Susan Bockrath, Executive Director of the NALHD says that, "I want to make sure that other folks, especially those who maybe don't think their work relates to Veterans, know that these trainings are coming up and that there really is value for everyone... teachers, principals, county clerks, law enforcement...everyone."

Last Few Days of 2014 Session US Supreme Court Holdings Divided on Significant Cases
The end of June 2015 was the setting for the disappearing days of the October 2014 term of the United States Supreme Court. The end of the term this session brought a variety of issues for the Court to rule on, including but not limited to health care, same sex marriages, method of carrying out an execution for the death penalty, redistricting, and EPA regulations.
In Glossip v. Gross, ___ U.S. ___ (2015), the Court held that the prisoners failed to establish a likelihood of success on the merits of their claim that the use of midazolam violates the Eighth Amendment (prohibiting cruel and unusual punishments) to the U.S. Constitution. This case was decided 5-4 by the Court. The case had been brought by Oklahoma prisoners. The decision is available here.
In Arizona State Legislature v. Arizona Independent Redistricting Commission, ___ U.S. ___ (2015), the Court held that the Arizona Legislature had standing to bring this suit and ultimately upheld the lower courts determination that legislative process included the ballot initiative process. The case had challenged a state constitutional amendment adopted in 2000 by Arizona voters which created a politically neutral commission for drawing the boundaries for state congressional districts every ten years. At issue in this case was the U.S. Constitution's Elections Clause because a portion of the provision states the manner of choosing Senators and Representatives shall be prescribed in each state by the legislature. This case was a 5-4 decision. The decision is available here.
In Michigan v. EPA, ___ U.S. ___ (2015), the Court held the Environmental Protection Agency (EPA) interpreted §7412(n)(1)(A) unreasonably when it deemed cost irrelevant to the decision to regulate power plants. It was determined the EPA must consider costs, including cost of compliance, before deciding whether regulation is appropriate and necessary. The decision was 5-4 in this case. In Obergefell v. Hodges, ___U.S. ___ (2015), the Fourteenth Amendment requires a State to license a marriage between two people of the same sex and to recognize a marriage between two people of the same sex when their marriage was lawfully performed out-of-State. This decision applies to all fifty states, including Nebraska. The case was decided 5-4. The decision is available here.
With respect to provisions of the Patient Protection Affordable Care Act, the Court in King v. Burwell, ___ U.S. ___ (2015), held Section 36B's tax credits are available to individuals in States that have a Federal Exchange. Those credits are necessary for the Federal Exchanges to function like their State Exchange counterparts, and to avoid the type of "calamitous" result that Congress plainly meant to avoid. The Court decided the case 6-3. The decision is available here.
In Walker v. Texas Div., Sons of Confederate Veterans, Inc., the Court held that Texas's specialty license plate designs constitute government speech, and thus Texas was entitled to refuse to issue plates featuring Sons of Confederate Veteran's (SVC) proposed design. When government speaks, it is not barred by the Free Speech Clause from determining the content of what it says. Just as Texas cannot require SCV to convey "the State's ideological message," SCV cannot force Texas to include a Confederate battle flag on its specialty license plates. (Citations omitted.) The decision was 5-4. The decision is available here.

New research sheds light on the pretrial population, policies and practices involved in county jails. Counties own 87 percent of jails in the United States through which they provide supervision, detention and other correctional services to over 700,000 people to maintain public safety and reduce recidivism. Many counties are at a crossroads between judges' decisions and increases in jail populations and costs. Meanwhile, the majority of the confined county jail population is both pretrial and low risk, according to research released today by the National Association of Counties (NACo). U.S. Supreme Court Decision: Health Insurance Marketplace Tax Credit Subsidies

A critical provision of the Affordable Care Act is to provide tax credit subsidies to qualifying individuals and families purchasing health insurance coverage through the Health Insurance Marketplace. The Supreme Court case King v. Burwell challenges whether the subsidies can be provided to those who obtain coverage via the federal marketplace.
