Speaker Sheldon Silver Indicted

    

At this time of year It is customary to describe in some detail the governor's "State of the State" delivered annually to a joint legislative session but the Speaker of the Assembly surrendered and was indicted  Wednesday morning on 5 or 6 counts arising from his outside income earned from two law firms for which he apparently did no work.  He is out on bond and a couple of million dollars in his bank accounts have been frozen or confiscated.

The Wednesday session of the assembly was cancelled as assembly democrats lined up to offer support for the speaker while the assembly minority leader called for him to step down from the speaker's dock.  One republican assemblyman invited the speaker to resign entirely but he has been calling for the speaker to go for the last two years.

 

Preet Bharara, the US attorney has said the speaker made off with $6 million in kickbacks and payoffs, either not reported as income or concealed as payment for his role as "of counsel" to Weitz and Luxemburg one of the largest tort law firms in the country.

 

Bharara's inquiry was motivated in part by the political contrivance known as the Moreland Commission, impaneled then disbanded by the governor when its investigation of government corruption got too close to the governor (apparently) but not before an investigatory dossier pointed the US attorney toward other targets including the speaker.  The Speaker said he will be exonerated or vindicated and awaits a legal process where his rights and privileges will be fully protected. If nothing else, the Speaker is one of the best pure politicians in the country, even if you eliminate "politician" as a pejorative, he remains a master tactician at his craft: smart, ruthless but only when justified by the rules of the game, and a good negotiator who has mastered the art of saying "no' and getting away with it, possibly because he reads the political landscape better than, say Govs. Pataki or Spitzer, Mayor Bloomberg or any of the majority leaders in the senate.  So it may not be his magic charm has abandon him so much as time and ambition.  After all, any speaker - here or in Congress - has cut so many deals over time and become so inured to threats and feints from opponents, that arrogance or sheer fatigue blinds then to the danger and ambitions of others.  Preet Bharara, as US attorney, has been mentioned as on the make for the governorship from whence sprang such candidates as Spitzer, Cuomo, [both AG before seeking higher office] and Giuliani who was the US attorney in the southern district of NY, the seat Mr. Bharara now occupies and from which he launched his Wall Street investigations.

 

The political culture in NY is fertile ground for corruption with reform measures never with enough support to prevail - the Moreland Commission was empaneled to put pressure on the legislature - but 25 or so investigations, convictions, imprisonments has had little impact on behavior of politicians.

 

In 1977-78 the public outcry over the treatment of nursing home patients at the hands of owners who skirted the law with the help of legislators, led to registration and reporting on lobbying activity.  Since management would henceforth be required to "authorize and designate" in writing a person to lobby on behalf of all petitioners (with some exceptions) I was queried as to whether we could comply with the law since it was not only me on the line but the person signing the authorization.  My answer then was "yes" but the real problem lay with all the legislators with law firm affiliations who would not have to register because of attorney/client privilege.  Over the years new laws require that legislators report "income" [within a range] derived from law firms but not the names of clients.  It is hard to tell how many nervous people hold public office in NY this morning but they may have good reason.  Meanwhile, the lobbying commission, properly the "Joint Commission on Public Integrity" will be busy coaching legislators how to pronounce the word "integrity" without it sticking in their throats. HOURS OF SERVICE RELIEF HAS BEEN GRANTED THRU JAN. 31 IN Bronx, Brooklyn, Dutchess, Nassau, New York, Orange, Queens, Richmond, Rockland, Ulster and Westchester Counties.

CASE 27647 - In the matter of motor carrier compliance with regulations pertaining to hours of service for operators of motor trucks, pursuant to 17 NYCRR 820.6.

AUTHORIZING EXCEPTIONS TO 17 NYCRR 820.6 DUE TO WINTER WEATHER ADVISORIES AND EXTENDED BELOW NORMAL TEMPERATURES IN THE HUDSON VALLEY AND METROPOLITAN REGIONS OF NEW YORK

Due to extended below normal temperatures and winter weather advisories in the Hudson Valley and Metropolitan Region of New York, it has been determined that action is necessary to address this potential emergency situation which could result in a threat to public health and safety in Bronx, Brooklyn, Dutchess, Nassau, New York, Orange, Queens, Richmond, Rockland, Ulster and Westchester Counties and that certain rules should be temporarily modified in order to ensure the adequate delivery of propane and distillate fuels for transportation and heating purposes as well as products necessary for the continued operations of power plants.

It has been determined that action is necessary to address this potential emergency situation which could result in a threat to public health and safety and that certain rules should be temporarily modified in order to ensure adequate delivery of propane, distillate fuels; including home heating oil, diesel fuel, kerosene, and jet-fuel; biofuels and residual fuels used for heating application, as transportation fuels, and for power generation and additional products necessary for the continued operations of power plants in Bronx, Brooklyn, Dutchess, Nassau, New York, Orange, Queens, Richmond, Rockland, Ulster and Westchester Counties.

Therefore, it is
ORDERED:
Pursuant to 17 NYCRR 820.12, the following hours of service regulations are modified with respect to the intrastate transportation of propane, distillate fuels and products necessary for the continued operations of power plants performed by motor carriers effective at the beginning of January 23, 2015 and terminating at the end of January 31, 2015 unless otherwise ordered:

(1) Section 820.6 is temporarily modified so that no motor carrier shall permit or require a driver of a commercial motor vehicle performing intrastate transportation in Bronx, Brooklyn, Dutchess, Nassau, New York, Orange, Queens, Richmond, Rockland, Ulster and Westchester Counties transporting propane, distillate fuels; including home heating oil, diesel fuel, kerosene, and jet-fuel; biofuels and residual fuels used for heating application, as transportation fuels, and for power generation and additional products necessary for the continued operations of power plants, regardless of the number of carriers using the driver's services, nor shall any driver drive for any period after having been on duty more than 72 hours in any seven (7) consecutive days if the employing motor carrier does not operate motor vehicles every day of the week. Any period of (7) seven consecutive days may end with the beginning of any off-duty period of (34) thirty-four or more consecutive hours.

(2) Section 820.6 is temporarily modified so that no motor carrier shall permit or require a driver of a commercial motor vehicle performing intrastate transportation in Bronx, Brooklyn, Dutchess, Nassau, New York, Orange, Queens, Richmond, Rockland, Ulster and Westchester Counties transporting propane, distillate fuels; including home heating oil, diesel fuel, kerosene, and jet-fuel; biofuels and residual fuels used for heating application, as transportation fuels, and for power generation and additional products necessary for the continued operations of power plants, regardless of the number of carriers using the driver's services, nor shall any driver drive for any period after having been on duty more than 84 hours in any eight (8) consecutive days if the employing motor carrier operates motor vehicles every day of the week. Any period of (8) eight consecutive days may end with the beginning of any off-duty period of (34) thirty-four or more consecutive hours.

(3) That no motor carrier operating under the terms of this order shall require or allow a fatigue or ill driver to operate a commercial motor vehicle. A driver who informs a motor carrier that he or she is not fit to drive shall be given a minimum of 10 consecutive off-duty hours before the driver may return to service.

(4) That all regulations pertaining to Commercial Driver License requirements, Controlled Substances and Alcohol Use and Testing requirements and Financial Responsibility requirements remain in force and effect for all motor carriers and drivers.


(5) That motor carriers that have an Out-of-Service Order in effect, or a suspension or revocation of a New York State Certificate as a motor carrier of property, are not eligible to take advantage of the relief from the regulation that this order provides.
