Governor Guomo Vetoes Container Law Again
Late last week New York Governor Cuomo vetoed the container law for the second time. 

The governor called for the bill on November 10th, however, the Legislative Digest did not issue a journal showing this transfer and the sponsors and supporters of the bill were not notified, according to NYPGA lobbyist Dick Brescia. Both sponsors had agreed to call the governor to ask for his approval at the appropriate time.  NYPGA had spoken key legislative leaders and calls had been placed to the Governor and his office in support of the bill.

Sponsors of the bill were not consulted about curing any "defect" in the bill.

In his veto message, the Governor asserted the legislation would  "limit consumers' ability to choose from whom they can purchase LPG" as well as "shift the cost of enforcing the private contract rights of LPG tank owner to the taxpayers of' New York."

Citing the need to "protect consumer choice for the many users of propane tanks, including homeowners, businesses and farmers," the Governor said "I am compelled to veto this bill. The bill is disapproved."

The NYPGA Board will discuss the Container Law at its December 3rd Board meeting.
Travel Restriction; Industry Responds
NYPGA joined the New York Motor Truck Association and others this week in response to the travel restrictions announced by Governor Cuomo in advance of this week's storm.

Beginning 7am, Wednesday, November 26, 2014, long tandem vehicles were banned from the New York State Thruway on I-90, both directions from Interchange 32 (Westmoreland/Rome) to Interchange 24 (Exit 24) and on I-87, both directions from Interchange 24 (Albany) to the New York City line. 

In response, NYPGA joined the New York Motor Truck Association and others on behalf of the thousands of truckers impacted by the ban, and asked the Governor to consider "severe economic and logistical implications"  to the ban which warranted some exceptions to the ban.

The letter cited the need for considerations for:

-the transportation of food; specifically implications to restocking and impact on perishable food products.

- the transportation of fuel; noting fuel is a critically important commodity, especially in the winter. 

- the transportation of emergency vehicles; noting some trucks, including small package delivery and dump trucks, carry products such as pharmaceuticals, sand, salt, heavy equipment and other items and products which are necessary to move in times of emergency.

The request asked for an order allowing trucks carrying food, fuel and emergency materials to continue to use I-84 and that the State of New York designate areas where trucks in transit, not carrying these commodities, be provided with safe areas of refuge until the ban is lifted.
Finger Lakes Project
NYPGA will participate in a radio show in the coming days in support of the Finger lakes Project.  The Joint Landowners Coalition of New York has become significant supporters of the project and JLC hosts a weekly radio show on WBNF Radio AM 1290 on Sundays at 7pm (eastern).   On Sunday, November 30th, they will be discussing the Finger Lakes LPG Storage project and NYPGA Executive Shane Sweet will participate as a panelist with 4 other guests.

As mentioned last issue, following the issuance by New York State's Department of Environmental Conservation (DEC) of a draft permit for Crestwood Midstream Partners'Finger Lakes initiative, DEC has scheduled an "issues conference" for Feb. 12, 2015 citing "extensive public interest" in the proposal.   Arrests of protesters have occurred for trespass on Crestwood property, blocking traffic, and failure to disperse when ordered to do so by police. Opponents have attempted to link the project to the wider issue of to hydraulic fracturing, or "fracking", which is generally opposed by environmental advocacy groups.

NYPGA will be filing an Amicus brief in support of the project.

A few weeks ago NYPGA President Rick Cummings messaged all NYPGA members about the available of bill stuffers that may be used to support the Finger Lake Project. Mike Taylor of Combined Energy Services sends word that CES has an abundance of sheet metal venting & ductwork pieces looking for a new home, and asked NYPGA to get the word out that this product is "for cheap".  

 

As for the tanks there are perhaps 200 available; 71 gal / 300 lb. tanks, all with a multivalve, no gauges, some galvanized. $70 each.
