Claims over E-Verify Misuse are Beginning 

On September 27, 2012, the Department of Justice (DOJ) settled a claim against Diversified Maintenance Systems (DMS), a Tampa based company, over allegations of discriminatory employment practices.  According to records, DMS terminated an employee after receiving a data mismatch from E-Verify. The employee claimed   she was not given proper instructions or paperwork to challenge the mismatch and prove her work eligibility.  DMS refused to reinstate the employee after the Social Security Administration verified  the employee was eligible to work.  As a result of the settlement, DMS must pay the employee back wages with interest, pay civil penalties, and undergo a company anti-discrimination training program. Until now, here has not been a large number of claims against employers over E-Verify misuse. As both Presidential candidates support increasing E-Verify we are likely to see more claims in the future. To read more, click here.

 

USICS Launches Online I-9 Resources in Spanish
On October 4th, USCIS launched a Spanish-language version of I-9 Central. The online resource center provides information and assistance for Form I-9, the most frequently accessed ICE form on USCIS.gov. The website now provides employers and employees free one-click access to Spanish-language resources, tips, and guidance in properly completing the Form I-9 and understanding the I-9 process. USCIS also offers a Spanish- language version of E-Verify Self-Check, a service that allows job seekers to check their employment status, and the I-9 Handbook for Employers. Go to I-9 Central en Espaņol, haga clic aqui
 
November Visa Bulletin Updates
US Visa

The Department of State has released the November 2012 Visa Bulletin. After the shocking retrogressions made in the October bulletin, there has been little change in priority dates. All EB-1 categories and foreign nationals in the EB-2 category, excluding for China and India, are current. The backlog continues in the EB-3 categories for all countries. Efficient Processing of U.S. Visa is Expected in India

The DOS Global support program in India is expected to streamline visa appointment scheduling, simplify fee payments and provide new delivery options. The program offers a new website available in English and Hindi. The website allows U.S. visa applicants to complete  applications, pay fees, schedule interviews and appointments for biometrics (fingerprint) collection. Applicants 

can also continue to schedule appointments using the existing call center. To view the new website, follow this link

        On October 7, I completed the Chicago Marathon and  getting one step closer to my goal to complete the World Five Marathon Majors. I have completed marathons in New York (11/2010), Boston (4/2012) and Chicago (10/2012) and I am scheduled to run London (4/2013).   The committement and determination to train and complete these amazing events helps me to serve you better.
