Historically, employees who were not eligible or not enrolled in the group health plan were nonetheless able to participate in the health flexible spending account. This was a great perk that employees with as few as 20 hours a week were able to enjoy. However, this is now a compliance violation. If you have employees in the flex plan who are not eligible for medical coverage, you could be hit with a penalty of up to $100 a day for each violation. Click here to read more.

All group health plans beginning compliance with the employer mandate this year must amend their plan documents to include additional eligibility wording. The good news is that there are still a few months left to take action. There is an additional requirement to distribute a summary of material modification (SMM) to participating employees. The plan document should be amended as soon as possible, and the SMM must be distributed no later than 210 days after the end of the 2015 plan year, unless the new language is included in a revised SPD.
