State Legislative Bill Report - July 25th, 2016

OSHA Delays Retaliation Provision of Workplace Injury Tracking Rule

The ACA Capital Report notified us today that the Occupational Safety and Health Administration (OSHA) announced July 13 that it is delaying enforcement of a provision from their May rulemaking that is intended to improve tracking of workplace injuries and illnesses. The provision, which was set to go into effect on Aug. 10, will now go into effect on Nov. 1, 2016.
 
The delayed provision would require employers to inform workers of their right to report work-related injuries and illnesses without fear of retaliation, implement procedures for reporting injuries and illnesses that are reasonable and do not deter workers from reporting, and adhere to the existing statutory prohibition on retaliating against workers.
 
The rulemaking requires certain employers to electronically submit injury and illness data that they are already required to record in their on-site OSHA Injury and Illness forms. Additionally, OSHA will post the establishment-specific injury and illness data it collects under this recordkeeping rule on its website.
 
The delay of the provision's implementation was announced by OSHA in a same-day memorandum to regional administrators. OSHA stated that they wanted the "opportunity to conduct additional outreach to the regulated community."
BAR-97 EIS Changes

BAR is working on a regulation change to require an Internet connection to the VID instead of the traditional dial-up line for BAR-97 inspections. To that end, BAR is working with the BAR-97 EIS manufacturers to implement an Internet connectivity update for newer EIS models. Older EIS models may require replacement. The proposed regulation would also require the use of a BAR-97 certified to an updated specification currently under development at BAR. In contrast to the existing EIS models, the updated systems would have a newer computer, operating system software and an integrated LPFET tester. These upgrades would address the issue of obsolete replacement parts, as well as allow BAR to address changing business needs in future software updates. Early indications from equipment manufacturers suggest the lease cost of an updated system would be competitive with service contracts for existing systems. The regulation would not be adopted until sometime next year, with implementation as early as January 2018. BAR plans to hold a regulation workshop on these changes on October 20, 2016.
BAR-OIS Software Update Version 6.6

On Monday, July 18, 2016, BAR-OIS software version 6.6 will be released to all stations. This update corrects the following issues: 1. When using Windows 10 and attempting to print a VIR, the print dialog box would appear but the VIR would not print. 2. If the BAR-OIS analyzer was set to an incorrect time zone, a VIR from the current day could not be reprinted. 3. Near the end of the calendar year, vehicles coming off of their 6-year exemption and receiving their first biennial inspection would be improperly warned that an inspection was not required. 4. If a BAR-OIS displayed an unexpected error, the cause of the error was not recorded. If you experience any issues with this new BAR-OIS Beta software release, please contact BAR's Industry Help Desk at (866) 860-8509. Explain that you have an issue with the BAR-OIS Beta software and the issue will be escalated to BAR Engineering for resolution.

NASTF - Programming with SAE J2534 Tops November 2 General Meeting
Aftermarket technical instructors are finding an alarming number of advanced service technicians who have already purchased an SAE J2534 vehicle interface device but have yet to use it in the profitable business of module programming. To address this unfortunate waste of valuable resources, the National Automotive Service Task Force (NASTF) will present a 90-minute session on the topic, November 2, during the NASTF Fall 2016 General Meeting, a featured event in the AAPEX Service Professional Program in Las Vegas, NV.
