ADA Regulatory Relief for Small Businesses Signed into Law
Last week, Governor Brown took an important step towards reducing the number of frivolous ADA lawsuits plaguing California's small business owners, by signing into law Senate Bill 269.
Senate Bill 269, authored by Senator Richard Roth (D-Riverside) and co-authored by Senator Andy Vidak (R-Hanford), seeks to incentivize businesses to proactively take steps to become accessible by providing them with 120 days from a Certified Access Specialist inspection to resolve any violations identified, without being subject to damages or litigation. It also provides businesses with 15 days to resolve any alleged violations regarding minor violations.
"SB 269 is a bipartisan, commonsense solution that will guarantee access for disabled Californians by providing small businesses with the tools and resources necessary to comply with state and federal disability access regulations," said Senator Roth.
This relief comes at a time when many small businesses, including independent auto repair shops, are being purposely targeted by lawyers looking to exploit even the most minor ADA non-compliance issues, threatening them with expensive lawsuits. These lawsuits put a tremendous strain on small business owners, who want to be compliant but lack the financial resources to quickly resolve non-compliance issues, and many are even forced out of business.
ASCCA believes SB 269 is a smart, balanced approach between preserving the civil rights of those who are disabled to ensure access to all public accommodations, and limiting the number of frivolous lawsuits threatened or filed against businesses that do not improve accessibility.
