OSHA Top 10 Citations for Dealerships and Service Centers in 2012

 


KPA, a dealer services and Internet marketing provider for automotive, truck and equipment dealerships and services companies has announced the annual top ten OSHA citations for dealerships and service centers. KPA developed its Top 10 List by combining 1) OSHA's Most Frequently Cited Regulations for Dealerships; and 2) OSHA's Most Frequently Cited Regulations for Repair Shops.

The List:
1. Hazard Communication
2. Respiratory Protection
3. Unguarded Machinery (Parts Grinder)
4. Electrical Safety Requirements
5. Powered Industrial Trucks
6. Exit Routes and Emergency Action Plans
7. Portable Fire Extinguishers
8. Spray Finishing Using Flammable Liquids (especially at collision centers)
9. General Duty Cause
10.Improperly Maintained Emergency Eyewash Stations. 

 

 

 

Californians Buy More Hybrids and Electric Cars

 

California car buyers are America's top consumers of hybrid and electric vehicles, reports Edmunds.com, an automotive shopping and information site.  It conducted a thorough analysis of hybrid and electric car buying in each of the 50 states and District of Columbia and found that California residents are buying a larger proportion of these vehicles.

 

Its analysis of Polk's new car registration data finds that 32 percent of all new electric vehicles and 24.7 percent of all new hybrid vehicles sold in the U.S. this year were registered in California, ranking the state first in the nation in both categories.  The rates far exceed the state's share of all new car registrations in the U.S., where California also ranks first overall at 11.1 percent year to date.

 

The news comes in what's shaping up to be the strongest year yet for alternative fuel vehicles nationwide.  Edmunds.com found that 3.4 percent of new car registrations through August 2012 were hybrid or electric vehicles, which is a full percentage point higher than the rate of 2.4 percent for all of 2011.

 

Edmunds.com projects that at least 43 all-new conventional hybrids, plug-in hybrids, battery-electric vehicles, diesels and fuel-cell electric vehicles are planned for introduction in the U.S. from now through 2015.

In his own words:

"I was raised in the shop where my dad was part owner and I started working with him when I was 15years old. I wanted to learn what made the car tick. I always loved to take things apart, fix it and put them back together!

 

It was June 1976 when I started working at Bill's Auto Electric & Repair. It was the business that my dad (Bob Toepp ) started working at in 1958 and in 1971 he and a partner, Don Bordessa bought from the owner, Bill Siemsen. I worked my way up the ladder from mopping floors, cleaning parts to working on cars. I went through the automotive apprenticeship program, went to Santa Rosa Junior College and graduated with an AA degree in automotive in June 1981. I knew that the automotive business was in my blood. I worked along side my dad until November, 1986 when he passed away. I stayed at Bills working for Don and in June 2007 I bought the business. Now I have 3 full-time employees and hoping to add another in 2013.

 

The ASCCA has been a big part of my business. I never would have otherwise found all of the available resources I have found in ASCCA for my business and for being the Chapter President & Chapter Representative for our local ASCCA Chapter 28 in Santa Rosa. It's all about having so many people in an organization to help you in business. Help is just a phone call away and that is PRICELESS.

 

My first set of advice that I would offer a shop owner in California is to get involved! By joining ASCCA you now belong to the biggest independent organization in the state of California. Together we make our voice louder, from the state capitol, fighting legislation against our business to CARB & BAR asking us for our help changing rules and regulations that pertain to our industry. Also, meeting with other shop owners at your local chapter meetings to statewide shop owners at Team Weekends and summer conferences, talking about new business ideas and going to training classes that will help improve your business. This also is PRICELESS.

ASCCA Attorney, Jack Molodanof Answers TeamTalk Question

 

Question: Is there any hope of collecting from a "ticket walker"?

Answer: As you know, a repair shop can always take legal action against the customer for the value of the services rendered to the vehicle in small claims court, etc. But it will be considered an unsecured claim and the shop will have to attempt to collect on any judgment through attachment of wages, etc.

If the shop can regain legal possession of the collateral (vehicle), this is more desirable because then the shop can lien sale car and be assured to recover some monies for the sale, but how to get the vehicle back to conduct a Lien sale once it has been take by customer through trickery or fraud?

Under current Lien law, Civil Code Section 3070 provides in pertinent part that:

a) Whenever the possessory lien upon any vehicle is lost through trick, fraud, or device, the repossession of the vehicle by the lienholder revives the possessory lien but any lien so revived is subordinate to any right, title, or interest of any person under any sale, transfer, encumbrance, lien, or other interest acquired or secured in good faith and for value between the time of the loss of possession and the time of repossession.

If a repair shop has a legal possessory lien (repairs completed, paper work all in order, etc.) and the vehicle is taken by the customer through trick or fraud, the repair shop can revive the possessory lien by legal repossession. Any repossession should be done through a reputable licensed repossession agency who will take all proper legal measures to insure that the repossession is done correctly (i.e. reports to legal authorities in case the car is reported stolen by the owner, etc.). Once possession of the vehicle has been legally regained, the repair shop can proceed and conduct a legal lien sale.

When making a recommendation, please use the following criteria:

  • Faithfully adheres to ASCCA code of ethics
  • Active proponent of ASCCA (both State and Chapter); talks up ASCCA to non-members
  • Actively helps oter shops succeed (both member and non-member shops)
  • Utilizes member benefits (ASCCA Advantage) and mentors new members utilizing benefits
  • Active in local Chapter (where applicable) and state events
  • Adds his/her voice to legislative issues; contacting representatives on key issues
  • Pays dues on time
  • Participates in/monitors Team Talk

 

Each nomination will be carefully reviewed and considered by the ASCCA Membership Committee. The pool of Members of the Month winners will be voted on by the Chapter Representatives Committee for Member of the Year to be honored at ASCCA's Summer Conference, June 21-23, 2013 at the Hilton Irvine Orange County.
