OFCCP listens to contractor suggestion to change the Voluntary Self-Identification of Disability Form

The Office of Federal Contract Compliance Programs (OFCCP) informed contractors at the ILG National Conference in August 2014, that it has requested approval to modify the Voluntary Self-Identification of Disability form.

The contractor community suggested that an electronic version of the form also be provided. In response to this, OFCCP requested approval to modify the form to allow for a drop-down menu of three optional responses, in lieu of checkboxes or radio buttons. The revised forms would ask the question, "Do you have a disability" followed by a drop-down menu with three response options: (1) Yes, I have a disability (or previously had a disability), (2) No, I don't have a disability; and (3) I don't wish to answer. The proposed form would allow an individual to leave the drop-down box empty, as with a hardcopy form.

The OFCCP also requested approval of the form in seven languages, in addition to English and Spanish.

Q. What changes do the new Section 503 regulations make to the contractor´s obligation to invite applicants to self-identify as an individual with a disability?
 
A. The new Section 503 regulations require contractors to invite applicants to self-identify at the pre-offer stage, in addition to the already required post-offer self-identification invitation. OFCCP added this requirement so that contractors can track the number of individuals with disabilities who apply for jobs and use this information to assess the effectiveness of their outreach and recruitment efforts. The pre-offer invitation to self-identify may be included in the contractors´ application materials for a position, but must be kept separate from the application.

In this year's Labor Day statement by Secretary Perez, he notes that the national holiday provides an opportunity to recognize "the invaluable contributions that working men and women make to our nation." The Obama administration has undertaken a series of initiatives that honor workers, including "investing more than a $1 billion in job-driven training programs to give Americans the skills employers need," the secretary said. Perez issued his Labor Day message on Aug. 28, noting that "I'm optimistic about where we're headed - and I know we wouldn't be where we are without the resilience, commitment and strength of American workers."
