California attorneys may be sanctioned for not properly supervising a hearing representative
 
It is common in the workers' comp world for non-attorney representatives to perform a multitude of legal tasks, such as preparing documents, researching issues and communicating with clients. These non-attorney employees are often referred to as "hearing representatives." They perform all of the above tasks and even make court appearances on behalf of clients. When this practice first occurred, there was some concern about oversight, given that these non-attorney representatives are not subject to discipline by the State Bar of California. In order to remedy this situation, regulations were adopted to ensure that non-attorney representatives are supervised by individuals who are subject to oversight by the State Bar of California and who must adhere to the State Bar Rules of Professional Conduct...read more.
