As a result of the Post-SB 863 onslaught of new regs, rules and procedures, the legal community is having a difficult time keeping up with many of the quirky twists and turns in the medical legal evaluation process. Applicant improperly requested all three QME panels at the same time, rather than completing an initial panel qualified medical evaluation before requesting evaluations in other specialties

 

In Martinez v. Santa Clarita Community College District, 2015 Cal. Wrk. Comp. P.D. LEXIS 2, the WCAB denied the applicant's petition for removal and affirmed the WCJ's finding that the applicant was entitled to a panel qualified medical evaluation in orthopedics, but was not currently entitled to panel qualified medical evaluations in the specialties of psychiatry and internal medicine as applicant had requested...read more.

SB 863 eliminated the requirement to propose an AME as well as the requirement to send a letter requesting a QME before requesting a panel from the Medical Unit  

 
In Bahena v. Charles Virzi Construction, 2014 Cal. Wrk. Comp. P.D. LEXIS 638, the WCAB affirmed the WCJ's finding that a request by a legally represented applicant for a QME panel in the chiropractic specialty that was made more than 10 days after the defendant sent a letter denying the applicant's claim, satisfied the requirements of LC 4060 and 4062.2(b), notwithstanding that the applicant did not first send the letter requesting the medical evaluation...read more.
