Ken PetersonChief Judge Looks Back on Two Years of Service, by Hon. Kenneth B. Peterson. Chief Judge Richard Newman has had a long history in the field of California workers' compensation law. Before entering state service, he worked as an attorney for the U.S. Department of Labor and in private practice, representing injured workers. In 1991, Judge Newman became counsel to the Administrative Director. From 1995 to 2009, he was a trial judge in the San Francisco WCAB District Office, before being appointed Presiding Judge, a position he held until 2011. Read the full article.

These regulations attempt to clarify what materials the Maximus IMR reviewer can rely on in making an IMR determination. My recent post titled "Unacceptable Regulations" criticized the most recent version of the IMR regs. The DWC is under time pressure to finish IMR regs. Unfortunately, the most recent version, though slightly better, still is problematic. Read more.

. . . applicant became dissatisfied with nurse case manager selected by defendant based on nurse case manager's failure to communicate and sought to select new nurse case manager, and WCAB held that while defendant initially had right to select nurse case manager under preferred procedure for selection set forth in Lamin v. City of Los Angeles (2004) 69 Cal. Comp. Cases 1002 (Noteworthy Panel Decision), applicant could object to defendant's selection at any time, that, while applicant was not permitted to unilaterally force appointment of new nurse case manager by simply declining to communicate with nurse case manager selected by defendant, evidence in this case indicated that applicant's dissatisfaction with nurse case manager was warranted given nurse case manager's failure to meet applicant's needs, and that on remand appropriate procedure for selecting new case manager is for applicant and defendant to attempt to reach agreement on new case manager and, if parties cannot agree, WCJ must appoint new nurse case manager.
