National Defense Authorization Act (NDAA) Nullification

 The Michigan Senate, with SB94, has passed an act to nullify the NDAA. The bill, if passed by the House and signed by the Governor, would make it illegal for Michigan to participate in NDAA indefinite detention: "...no member of the Michigan national guard on active state service shall aid an agency of the armed forces of the United States in any investigation, prosecution, or detention of any person pursuant to section 1021 of the National Defense Authorization Act..." As far back as our founding as a nation, Thomas Jefferson said Nullification is the rightful remedy to unlawful behavior by our agents in the general government, and James Madison said it is the duty of the state to interpose on our behalf against the Federal government in those cases. There's no serious thought that supports the idea that the federal government has the constitutional authority to require state agents to enforce federal laws. Even the Supreme Court has affirmed this more than once in recent history. Michigan was a leader in the Nullification of the Fugitive Slave Act in the 1850s, and the NDAA is another example of an unconstitutional and immoral act, with its indefinite detention provisions. Let your State Representative know if you support SB94. |
