Hearing examiner to deny radio tower application


Whatcom County Hearing Examiner Michael Bobbink has decided to deny BBC Broadcasting's application to construct AM radio towers in Point Roberts. 

In a memo sent October 20, Bobbink said:

After a thorough review of the pleadings, supporting documents, comprehensive plan, Whatcom County Zoning Ordinance and case caw, I have decided I am going to grant the motion to deny the application on the basis that the height requirements of the Point Roberts Special District apply to this application; that the application cannot functionally meet these requirements; and that the requested zoning conditional use permit application to allow BBC Broadcasting, Inc. to construct and operate a five antenna array of AM radio broadcast towers of approximately 145 feet to 150 feet in height, at MacKenzie Way, Point Roberts, Washington, must be denied.

For this reason I am striking the hearing dates previously scheduled, starting with the hearing set for next Monday, October 27, 2014. I am preparing a set of findings and facts, a detailed set of conclusions of law addressing the various issues, and a decision denying the application. I expect this decision to be available sometime next week.
