Company Record Keeping Regulations - Comment Period Extended to March 8, 2014
The U.S. Occupational Safety and Health Administration (Federal OSHA) announced that it will extend the comment period pertaining to proposed amendments to the record keeping regulations that would require employers to submit company-wide injury and illness information on a quarterly basis to a federal website. It further states Federal OSHA would post the data on its public website and use that data to target companies for inspections. Currently companies are only required to keep a log of their injury and illness information for each establishment and provide that log to OSHA upon request. As with any Federal OSHA regulation, Arizona Department of Occupational Safety and Health would be required to adopt substantially similar regulations. Arizona's Fall Protection Standard Under Scrutiny by Federal OSHA
In 2011, at the request of the Home Builders Association of Central Arizona, the state legislature passed SB 1441 changing the height threshold of conventional fall protection from 6 to 15 feet, essentially providing a blanket exemption for single story construction with no guarantee that conventional fall protection will be utilized above 15 feet. This legislation jeopardizes the federal approval of a state-run OSHA program and opens the door to federal OSHA jurisdiction and enforcement. In an attempt to continue the operation of Arizona's state-run plan by the Arizona Department of Occupational Safety and Health, various stakeholders will be working together to provide Federal OSHA with assurances the Arizona program will be at least as effective as the federal program for fall protection standards.

Fraud Alert - Fraudulent Solicitation Under Guise of "Labor Standards Compliance Office"
Recently some companies have reported to the Industrial Commission of Arizona (ICA) that they have received notices in the mail from a return address of East Thistle Drive, Phoenix, AZ labeled "Final Notice, Labor Standards Compliance Office". The documentation is written in such a manner that it has led some to conclude it is an official notice from a government agency requiring companies to pay a fee of $295.00. Neither the ICA, Arizona Department of Labor, or Arizona Department of Occupational Safety and Health have generated such a document.
