Health Care Reform Update; DOL Issues Model Exchange Notices

John F. Webber, CEBS, CLU

Vice President

The Affordable Care Act, (ACA) requires online competitive Health Insurance Marketplaces, also known as Exchanges to be available in all states for individuals and small businesses beginning January 1, 2014. Open enrollment for health insurance through the Exchanges will begin October 1, 2013 for a January 1, 2014 effective date. Employers must provide all current employees with a written notice about the ACA Exchanges by October 1, 2013 and new employees within 14 days of their date of hire. All employers, who are subject to the Fair Labor Standards Act, (FLSA) must provide this ACA Exchange notice.

The Exchange notice must include information about the existence of the Health Insurance Marketplaces, (Exchange) with the contact information and services of the Exchange. The notice must also let the employee know that he/she may be eligible for a premium tax credit, (if the employee purchases a qualified health plan through the Exchange).  Finally, the notice must state that if they employee purchases a qualified health plan through the Exchange, then the employee may lose the employer's contribution to any health plan offered by the employer.
