Greetings! 

 

I apologize for the length of this email; however, there is much to report this month. Let's begin with an update on our strategy to deal with the Governor's gun ban.

In an obvious effort to gain political advantage; Governor O'Malley exploited the wave of emotion associated with the tragedy in Newtown. SB 281 was hastily cobbled together by simply using language extracted from multiple failed gun control bills from Maryland as well as legislation in other states.
 

In its original form, SB 281 was a convoluted, vague and confusing piece of legislation which was never formally reviewed by the Maryland State Police. Informal advice from knowledgeable persons was ignored. Subsequent amendments in the Committees as well as in the Senate and House only served to make SB 281 even more confusing. All amendments which could have improved the bill language were rejected out of hand.

 

In its final form, SB 281 is a dysfunctional patchwork quilt of gun bans, licensing of law-abiding citizens, training, increased reporting requirements for licensed dealers, additional concealed carry permit restrictions, hunting laws, and token mental health legislation. In more rational times, SB 281 would never have passed in Committee, let alone become law.

 

With the passage of SB 281 in the Maryland General Assembly, we were faced with the difficult task of choosing the best strategy to undo the damage done to the Constitutional Rights of Maryland's law abiding citizens. In the most basic terms our options were to either petition SB 281 to a referendum in 2014, or pursue litigation to address the most onerous and unconstitutional provisions in the bill. After very careful research and thoughtful consideration, we came to the unanimous conclusion that litigation was preferable to a referendum.

 

Therefore, we are moving forward with the NRA to pursue redress of our grievances in the Courts. As you know, litigation is a very costly endeavor. The NRA cannot and should not bear the full financial lawsuits filed on our behalf. This is our fight! You came thru with "boots on the ground", letters, phone calls and over 1,566,000 emails. You stood with us against the tyranny of the left, and we know that you will stand with us now.

 

Take Back Maryland, a new statewide Political Action Committee (PAC) has been formed as means to raise the necessary funds defend our rights as well as support Pro-2nd Amendment candidates in the 2014 Election.

2013 Annual Machine Gun Registrations are Due

Maryland law requires that all machine guns be registered annually during the month of May.

The Maryland State Police (MSP) ave already sent the registration forms via standard mail. Despite what the MSP website indicates, ONLY the initial registration forms are available in PDF on the MSP website.

AGC has once again made the Annual Machine Gun Registration Form available on its website. This form features "fillable" fields for your convenience. Keep a copy of this file. In future years, if nothing has changed (and MSP has not revised the form) all you will need to do is update the registaration year and the date in the signature block and reprint the form.

We strongly recommend that you insist on receiving stamped copies of your registration forms as proof that you have complied with the law. Do not trust your freedom the MSP.

Woollard Case Update - En Banc Petition Denied

Attorney Allan Gura's petition to the 4th Circuit Court for an en banc hearing was denied. This is a procedural move and the denial was not unexpected. 

Rule 35. En Banc Determination

(a) When Hearing or Rehearing En Banc May Be Ordered. A majority of the circuit judges who are in regular active service and who are not disqualified may order that an appeal or other proceeding be heard or reheard by the court of appeals en banc. An en banc hearing or rehearing is not favored and ordinarily will not be ordered unless:

(1) en banc consideration is necessary to secure or maintain uniformity of the court's decisions; or

(2) the proceeding involves a question of exceptional importance.

A Forum on Defending Maryland's Firearm Safety Act

The gun lobby plans to challenge Maryland's courageous steps to control gun violence, the Firearm Safety Act, certainly through a lawsuit, possibly in a referendum. The leaders who fought for the law will discuss the implementation and defense of the law, which requires fingerprinting and licensing of handgun purchasers, bans the sale of assault weapons and high capacity gun magazines and gives the State Police the authority to regulate gun dealers.

Maryland Attorney General Gansler's Statewide Gun Turn-in for Felons

Adding an additional and time-tested tool to the reduction of illegal handguns on our streets, Attorney General Gansler that Saturday, May 11, 2013 will be The Attorney General's 1st Annual Statewide Gun Turn-in Day. Working with state's attorneys and law enforcement in local jurisdictions across the state, the gun turn-in event will allow anyone to surrender illegal or unwanted handguns, rifles, shotguns or air guns to local law enforcement, no questions asked. No personal identification will be required.
