 NYSREEF SCHOLARSHIP WINNERS
Congratulations to NYSREEF Scholarship Winners, John Baron and Sylvia Ryndock!
The New York State Real Estate Education Foundation announced the award of $10,234 in scholarships. Scholarships are now awarded twice each year. Since 2004 the New York State Real Estate Education Foundation (NYSREEF) has awarded more than 700 tuition scholarships totaling almost $200,000 for national REALTORŪ designation courses. These scholarships are made possible through the generous funding received from NYSAR, Local boards and REALTORŪ members, who are committed to delivering excellent service to today's consumers.

GRAR HOLIDAY GALA The Holiday Party, hosted by Gallo & Iacovangelo, LLP, to benefit Hillside Children's Center is on Thursday, December 17, 2015 at the Doubletree Hotel by Hilton Rochester (1111 Jefferson Road) from 6:30 p.m. - 10:00 p.m. with music from DJ Rein Brucker.  Full House Entertainment will have two Photo Booth's again this year! The food is fantastic and the networking a plus! 
***Please bring an unwrapped gift (ages 10-16) that will be contributed to Hillside (serving over 3,600 area children).
Tickets are only $25 each or reserved tables of 10 are available for $250. They can be purchased by calling Member Services at 292-5000 or by downloading a ticket form here and sending it back with payment.  Please contact Diane Russi at 341-2122 with any questions.

ETHICSEthical Practices Reminder
SOLICITING ACTIVE LISTINGS IS NOT OK!
Before entering a listing in the MLS, members should ALWAYS check the data base. The same is true for soliciting expired listings. Check to make sure property is not relisted! If a listing is already active in MLS, the homeowner should NOT be contacted by another agent or broker who is soliciting to list their property. This practice is quite often upsetting to homeowners, it is unprofessional and may be a violation of MLS Rules and the NAR Code of Ethics.
Upon joining the Association, all members agree to abide by MLS Rules and Regulations and the Code of Ethics.

How do I know if the property is Multiple Listed?
  • If there is a For Sale or For Rent sign on property, DO NOT SOLICIT.
  • NYSAMLS Rule: Section 1.17 Duplicate Listings: In order to protect the database the listing agent must monitor his/her listings and sales and see that they are appropriately accounted for even if the transaction on the property continues after the expiration date (Pending status). Always search the database prior to entering a new listing. This will assure that a listing is not a duplicate.
  •  Listings in MLS that are in Withdrawn status are STILL UNDER Contract, they are just not being marketed at the time. Withdrawn status listings cannot be listed by another broker-the same is true for T, C, P and U status.
  • Do not assume that because a listing showed up on your hotsheet as EXPIRED,
  • that it is not under contract again. ALWAYS Check database!
Article 16
REALTORSŪ shall not engage in any practice or take any action inconsistent with exclusive representation or exclusive brokerage relationship agreements that other REALTORSŪ have with clients. (Amended 1/04)
  • Standard of Practice 16-2

Article 16 does not preclude REALTORSŪ from making general announcements to prospects describing their services and the terms of their availability even though some recipients may have entered into agency agreements or other exclusive relationships with another REALTORŪ.   

A general telephone canvass, general mailing or distribution addressed to all prospects in a given geographical area or in a given profession, business, club, or organization, or other classification or group is deemed "general" for purposes of this standard. (Amended 1/04)

 

Article 16 is intended to recognize as unethical 2 basic types of solicitations:
  • First, telephone or personal solicitations of property owners who have been identified by a real estate sign, multiple listing compilation, or other information service as having exclusively listed their property with another REALTORŪ; and
  • Second, mail or other forms of written solicitations of prospects whose properties are exclusively listed with another REALTORŪ when such solicitations are not part of a general mailing but are directed specifically to property owners identified through compilations of current listings, "for sale" or "for rent" signs, or other sources of information required by Article 3 and Multiple Listing Service rules to be made available to other REALTORSŪ under offers of sub agency or cooperation. Although GRAR and the MLS have various rules and tools in place to assist you with the compliance of your listings and practices, you as listing agent/broker are essentially responsible for your actions.

NYSAR ADVANCES FIRST-TIME HOMEBUYER PROPOSAL WITH GOVERNOR'S OFFICE
NYSAR CEO Duncan MacKenzie and Government Affairs Director Mike Kelly met with representatives from Gov. Andrew Cuomo's office and the Division of Budget regarding a proposal to implement a statewide First-Time Home Buyer Savings Account program, which would allow individuals and couples to put aside money in a special savings account to be used only for upfront costs associated with purchasing a first home in New York State. This will continue to be one of NYSAR's legislative priorities in 2016.

FHA TO CHANGE CONDO POLICY
Federal Housing Administration announced it will make changes to its condo policies, including the lengthy and complex recertification process, burdensome owner-occupancy requirements, and limits on the types of property insurance that are considered acceptable coverage. The National Association of RealtorsŪ  has long advocated for broad improvements to FHA's condo rules, arguing that existing policy is overly restrictive and keeps many consumers from buying and selling a home. CALL FOR ACTION RESULTS
Thank You for Taking Action to Stop Congress From Taking Money From Future Homeowners
More than 178,000 REALTORSŪ-almost 19 percent of all members-responded to the taking of money from future homeowners. 383 GRAR Members, an 18.4% participation rate, took the time to make their voices heard.
Thirty-three states and two territories broke through the 20 percent mark in one of the most successful Calls for Action in NAR history. Find Results Here
