DUES REMINDER
The second payment of the divided dues option ($430 for MLS Fees, payable to GENRIS) is due no later than Tuesday, September 9 to avoid a $50 late fee. Fees for administration staff, if applicable, are also due at this time. PAY ONLINE HERE.  If you subscribed for the Auto-Pay service, the GENRIS MLS fee will be automatically deducted from your credit/debit card on September 5.
Note: You can still sign up for this service (or cancel it if you already subscribed, update your expirations date &/or change credit cards) in the The final divided dues installment of $245 (NYSAR/NAR portion) is due by November 1.

UPDATE TO C AND U STATUSES IN MLS; NEW CHANGE FORM
The NYS Alliance of MLS's approved the following changes to the "C" (Continue to Show - Under Contract) and "U" (Under Contract - Do Not Show) statuses which will become effective in the MLS by the end of the month.  A NEW Change Form is now available at this link and may be used immediately:  This form will also be made available on Instanet forms as soon as possible.

 

Please note that our MLS Rules have been updated to show the following explanation for the Active Status, effective when the new field is available in the MLS (see below):

  • Active:  Property available to be shown, no signed contract exists, with the exception of a contract with the contingency of a property to sell, to be identified in the Showing Instructions as "Contingent upon sale of a property" (which will be added to the database).
  • Continue to Show: Property available to be shown, contract exists - See Private Remarks.

Changes being made in the MLS to accommodate above rule change:

  • A table value will be added in the 'Showing Instructions' field for "Contingent Upon Sale of Property" (abbreviated as CONTSALE).
  • The "Type of Contingency" field will be removed from C Status after moving listings as follows:
    • Listings currently in "C" status with "Other" selected in the Type of Contingency field will remain in "C" Status.
    • Listings currently in "C" status with "Home Sale" selected in the Type of Contingency field will be moved to "Active" and the Showing Instructions field will say "Contingent Upon Sale of Property".
  • Rename C status From "Continue to Show - Under Contract"  to "Continue to Show"
  • The U status will no longer be an option. Listings in this status will be moved to "P" (Pending Sale).
NEW FEATURES OF GRAR.ORG
Have you noticed a new look and feel on www.grar.org? GRAR has been updating www.grar.org to make it easier to navigate and view from a mobile device.  In addition to making the site easier to access on a mobile device, we've added some features that you may find useful:
1.    Direct link from the new MLS Portal, saves time logging in when you are already logged into the portal.
2.    Added a page for MLS Tools & Benefits detailing what is available to you as an MLS Participant.
3.    Added a page for the MLS Portal Support and one for Data Co-op.

REALTORŪ-BAR COMMITTEE ANSWERS QUESTION ABOUT LEAD ADDENDUM
From time to time, we get questions about our forms that we run past our REALTOR Bar Committee Attorney, Jill Myers, for interpretation. Below is a recent question and answer that we'd like to share.
Q.  Do I need a lead addendum for properties built 'prior to 1978' or '1978 and prior'?  
A.  "The Lead Compliance Addendum is required for residential housing built prior to 1978.   It doesn't apply to housing built in 1978 (although there's a small exception if house construction started in 1977 that was finished in 1978 -  If the building permit was pulled in 1977 and the house was finished in 1978, one is still required to complete Lead Compliance Addendum)."

YRN "REALTORŪ ROOKIE OF THE YEAR AWARD"
The Greater Rochester Chapter of the Young REALTORSŪ  Network is currently seeking candidate applications for the "YRN REALTORŪ Rookie of the Year".
All applicants must be GRAR members for less than 2 years and will be reviewed based on career success and involvement with community and real estate organizations.

SALES MASTER AWARDS CRITERIA
It is that time of year again for the GRAR Sales Master Awards. The final deadline for submitting your entry will be Wednesday, October 1, 2014, with no exceptions.
All entries will require a cover sheet that the Designated Broker will sign to confirm/approve of all listings being submitted on the award application. Click here for the CRITERIA FORM and COVER SHEET.

The consecutive 12 month period for the 2014 Awards is September 1, 2013 through August 31, 2014. The Sales Master Award Recognition Reception, sponsored by Fairport Mortgage, will be held at Locust Hill Country Club on Friday evening November 14, 2014. YRN Cell Phone Collection for Charity
The Young REALTORSŪ Network is collecting cell phones to be donated to domestic violence centers. Each NYSAR region will be competing to see who can collect the most. The region that collects the most phones will be spotlighted in a future issue of New York State REALTORŪ magazine. Please drop your old cell phone off at GRAR before Sept. 26th.

GOV. CUOMO SIGNS FIRE SPRINKLER LEGISLATION
Governor Andrew Cuomo has signed legislation that requires builders of one- and two-family homes to provide buyers with information on the installation of automatic sprinkler systems. NYSAR strongly supported this legislation, as the decision to install fire sprinklers should be a consumer choice. The purchase or construction of a home for many is one of the largest financial commitments they will ever make. Requiring builders to provide potential buyers with accurate information on the costs and benefits of installing fire sprinklers is an appropriate and responsible way to ensure consumers are fully aware and informed about their building decisions.  To read the governor's press release, click here

HUD OKS DUAL AGENCY IN FHA PRE-FORECLOSURE TRANSACTIONS
but require the properties to be listed for at least 15 calendar days before any offers are evaluated. If multiple offers are received, the listing agent or broker must forward the offer that provides the highest net return to US Department of Housing and Urban Development and meets criteria for bid requirements, which must be implemented for all "New Approvals to Participate" no later than October 1, 2014.  Click Here for more

US SENATE APPROVES TRIA REAUTHORIZATION
The Senate approved S. 2244, the Terrorism Risk Insurance Program Reauthorization Act of 2014, which allows the continuation of the federal program or seven years.  The government backstop created by the program for cases of catastrophic losses due to a terrorist event allows private insurers to provide affordable terrorism insurance coverage throughout the country. The recoupment provision in it protects taxpayers, while costing the government nothing. Read More

NAR COMMENTS ON USE OF DRONES FOR REAL ESTATE LISTINGS

NAR submitted comments on the Federal Aviation Administration's (FAA) recent "Interpretation of the Special Rule for Model Aircraft," which specifically mentioned REALTORSŪ use of Unmanned Aerial Vehicles (UAVs) for taking property videos as being a commercial use and therefore prohibited under FAA policy. NAR encourages the FAA to comply with the statutory directives issued by Congress to develop rules that integrate UAVs into the national airspace by 2015. Click Here for the Comments
