Settlement Agreements and Voluntary Compliance Agreements

There appeared to be interest in our last bulletin regarding settlement agreements with the U.S. Department of Justice regarding accessible design.  DCAB will try to include a link to at least one case of interest in each newsletter.  For the first in an ongoing section, we've covered a variety of topics that we felt might be of interest:

Private Business:

- Settlement Agreement between the USA and Jerry and Carlyn DeSpain Rental LLC: http://www.ada.gov/despain_rental_sa.htm.

Entertainment:

- Voluntary Compliance Agreement between the USA and Lincoln Center for the Performing Arts, Inc.: http://www.ada.gov/vca-lincoln-center.htm.

Hospitality:

- Voluntary Compliance Agreement between the USA and Mayfair Hotel Associates LLC: http://www.ada.gov/mayfair-hotel-sa.htm.

- Settlement Agreement between the USA and Hotel Headquarters Associates, L.P., Headquarters Hotel Management, LLC and Sheraton Operating Corporation:  http://www.ada.gov/sheraton_ac_sa.htm.

New Technical Assistance Guide

The U.S. Access Board has begun to develop informational bulletins and short animations to explain and illustrate the various accessibility requirements in the ADA Standards.

Currently they have completed a Guide to the ADA Standards for:
  • Scoping requirements for new construction and alterations
  • Floor and ground surfaces
  • Clear floor or ground space and turning space
  • Operable parts
  • Protruding objects
  • Accessible routes
  • Entrances, doors, and gates
  • Ramps and curb ramps
  • Elevators and platform lifts
  • Accessible means of egress
