What projects must be submitted to DCAB for review? 
   

In the 2015 legislative session, the Legislature passed Act 45 which amends the definition of 'public buildings, facilities, and sites' as:

 

"Public buildings, facilities, and sites" means buildings, facilities, sites, and the infrastructure thereof that:  

 

1)   Are designed, constructed, purchased, or leased with the use of any state or county funds or federal funds administered by the State or a county;    

2)  House state or county programs, services, or activities that are intended to be accessed by the general public;    

3)  Are places of public accommodation or commercial facilities under the Americans with Disabilities Act, title 28 Code of Federal Regulations part 36, and are constructed on state or county lands; or    

4)  Are constructed on lands that will be transferred to the State or a county upon completion of construction.

 

Item #3 above includes structures that are privately owned and/or are constructed with the use of only private funds on lands owned by the State or a county. 

 


What do I submit to DCAB for review?

 
      
  • DCAB requires a complete set of drawings and/or specifications that are being issued for construction, to be submitted for each review.  (DCAB accepts "half-size" sets for review.)
  • A completed HRS §103-50 Transmittal Form is required to be attached to new submittals and resubmittals. DCAB requires the use of the current transmittal form dated December 2012. The form can be downloaded at: http://health.hawaii.gov/dcab/facility-access/forms/
    • A new submittal is the initial submission of plans and specifications to DCAB for a plan review.
    • A resubmittal is when revised plans and specifications are submitted to DCAB for an additional plan review.
  • A document review fee is required with all new submittals. 

Submittals with the incorrect design review fee, the use of the incorrect form or submittals with an incomplete transmittal form will not be accepted or logged in for review.  

 

 


 
How do I calculate the required design fee?
 
 
 

On the second page of the HRS §103-50 Transmittal Form is an explanation of how to calculate the design review fee. DCAB limits the maximum design review fee for infrastructure projects or projects managed by private nonprofit entities to $3,000.

 

1)     What is an "infrastructure" project? HRS §103-50 defines "infrastructure" or "infrastructure projects" as those that include "water, drainage, sewer, waste disposal and waste treatment systems, roads, and street lighting and projects relating to that infrastructure. Projects with significant work to accessible elements and spaces shall not be considered infrastructure projects."

2)     A "private nonprofit entity" does not include a State or county department/agency. The department/agency responsible for the project or the private, nonprofit must submit a letter verifying the nonprofit status of the private entity.

How long does a review take?

DCAB reviews all projects in the order they are submitted, regardless of whether it is a new submittal or a resubmittal. Typically it takes approximately four (4) weeks for a new submittal or a resubmittal to be reviewed from the time it is accepted (transmittal form is correct, complete and the required fee was submitted) and logged in. However, at the end of the calendar year or end of a fiscal year, the review may take longer due to the high volume of projects submitted during those periods. Projects with deficiencies are required to be resubmitted for review.
