FAQ

Q: Must an accessible drinking fountain be designed for front approach or can a parallel approach be provided?

A:  Wheelchair accessible drinking fountains are required to provide clear floor and ground space positioned for a front approach.  The clear floor space must be      centered on the unit.

A parallel approach may only be provided for units designed for children's use where  the spout is 30 inches (760 mm) maximum above the finished floor or ground and is 3-1/2 inches (90 mm) maximum from the front edge of the unit.

U.S. Department of Justice Settlement Agreements

When complaints are filed, the U.S. Department of Justice (DOJ) will investigate the complaints and in many cases will reach a settlement agreement with the business or entity to avoid potential litigation.  The following are two recent settlement agreements:

Rainforest Café, Atlantic City, NJ:  During the course of its investigation, the DOJ found violations of the 1991 ADA Standards for Accessible Design with regards to the Women's and Men's Toilet Rooms and the sales and service counters in the Rainforest Café Gift Shop.  To see the terms of the agreement go to:
http://www.ada.gov/rain_forest_cafe_sa.htm.

National Museum of Crime and Punishment, Washington, D.C.:  The DOJ found the museum did not alter their facilities in a manner that was readily accessible to and usable by persons with disabilities.  In addition, they failed to "make all of its exhibits, public programs, and other offerings accessible, and failed to furnish appropriate auxiliary aids and services to ensure effective communication with patrons with disabilities."  To see the terms of the agreement go to:
