U.S. 1st Circuit Court of Appeals Upholds Discharge in ADA Case

An employee, who was working at Wal-Mart stores, claimed that even though she was a disabled person because of her pregnancy, she could still perform the essential functions of her position. The defendant employer disagreed stating that in her position as an unloader the essential functions required her to lift 60 lbs. They indicated she could not do this with or without accommodation given her doctors restrictions.     
              
 New FMLA Notice Poster and Employer Guidebook Unveiled

The Department of Labor will require employers to post a new FMLA notice in their workplaces, the agency announced on Monday, April 25, on the opening day of the Disability Management Employer Coalition (DMEC) FMLA/ADA Employer Compliance Conference in Pittsburgh.

Recently, UTCA was notified by the Director of UI Policy and Performance (MA DUA), the Adjudication Unit will no longer reach out to TPAs or employers for a second attempt to gather information, where the first attempt goes unanswered.
